نظارت قضایی بر آرای مراجع اختصاصی دادرسی اداری در ایران و لبنان

قضاوت اداری در ایران و لبنان از نظر عملی تا حدود زیادی شبیه هستند و دو مرجع دیوان عدالت اداری و شورای دولتی در عالی‌ترین سطح قضاوت اداری قرار دارند. در سطح پایین‌تر، مراجع اختصاصی دادرسی اداری در هر دو نظام از جایگاه ممتازی برخوردارند و در موضوعات گوناگون و متنوع اداری به حل و فصل اختلافات و صدور رای می‌پردازند. این مراجع گوناگونی زیادی دارند و از طرفی از یک نظام قانونی واحد نیز پیروی نمی‌کنند. نظام حقوقی ایران در این خصوص با آشفتگی در قلمرو نظارت دیوان عدالت اداری مواجه شده است؛ به‌طوری که گاهی دیوان عدالت اداری مرجع نهایی اعتراض است و گاه دادگاه‌های عمومی. رویۀ قضایی دیوان در رسیدگی به آرای مراجع یادشده یکسان نیست و دچار تشتت آرا در بعضی از زمینه‌ها است. هدف این پژوهش مقایسۀ نظارت قضایی بر آرای مراجع اختصاصی دادرسی اداری در این دو نظام حقوقی است. پژوهش پیشِ رو به روش تطبیقی و توصیفی تحلیلی به بررسی نظارت قضایی بر آرای مراجع اختصاصی دادرسی اداری در دو نظام حقوقی ایران و لبنان می‌پردازد. مهم‌ترین یافتۀ این پژوهش نشان می‌دهد که دیوان عدالت اداری بر‌خلاف شورای دولتی لبنان صلاحیت خود را نسبت به همۀ مراجع اختصاصی دادرسی اداری نپذیرفته است.

Judicial Review on the Decisions of the Specific Authorities of the Administrative Hearing in Iran and Lebanon

Administrative judgment is functionally very similar in Iran and Lebanon. In the highest level of administrative judgment in these two countries, there are two authorities of “Administrative Justice Court” and “the Council of the State”. In both countries, in lower levels of administrative hearing, the specific authorities have special positions and do the dispute resolution and decisionmaking in various subjects of administrative affairs. These authorities have plenty of types and they do not follow a single judicial law order. The legal system of Iran encounters a chaos in the field of judicial review of “Administrative Justice Court” in the way that sometimes the general courts are the ultimate authority to hear the contest of awards and sometime the “Administrative Justice Court” does so. The AJC does not take a unique judicial procedure in processing the verdicts of these authorities and a divergence of decisions is observed in this regard.The main purpose of this research is to compare the judicial review on the decisions of the specific authorities of administrative hearing in these two legal systems. The methodology of the research is comparative and descriptive analytical. The most important finding of this study shows thatthe “Administrative Justice Court” of Iran unlike the “Council of the State” of Lebanon, has not accepted its competency about all the specific authorities of administrative hearings.
