بررسی توافقنامه آرتمیس و تاثیر آن در تکامل حقوق فضا

این مقاله به دلیل شبهه در استفاده از متن مقاله دیگری بدون ذکر منبع، توسط نویسنده آن پس گرفته شده است. سرعت رشد تکنولوژی در تمام زمینه ها از جمله فضای ماوراءجو، باعث شده است که کشورها درصدد به روز کردن معاهدات و توافق‌نامه های مرتبط با آن زمینه شوند. در این راستا، می توان به قانون فعالیت های معدنی فضایی آمریکا در سال 2015، قانون استخراج فضایی لوکزامبورگ در سال 2017 و در نهایت توافق‌نامه آرتمیس که در اکتبر سال 2020 توسط 32 کشور تصویب شد، اشاره کرد. توافق‌نامه آرتمیس بخشی از برنامه گسترده‌تر آرتمیس بوده که توسط سازمان ملی هوانوردی و فضایی آمریکا (nasa) هدایت می‌شوند. سوالی که در این مقاله باید پاسخ داده شود این است که آیا این توافق‌نامه می‌تواند بر پیشرفت حقوق بین‌الملل فضایی تاثیر بگذارد؟ روش نوشتاری که در این مقاله استفاده شده است، روش (اسنادی) کتابخانه ای است. این مقاله به بررسی میزان انطباق توافق‌نامه آرتمیس با قوانین و استانداردهای بین‌المللی از جمله معاهده فضای ماوراءجو و موافقت‌نامه ماه می‌پردازد. نتایج این پژوهش نشان می دهد در حالیکه این توافق‌نامه، ریشه در مفاد معاهده فضا دارد، با جایگزینی رویکرد پیش بینی کننده برای تنظیم فعالیت های فضا، نوآوری قابل توجهی در حقوق بین الملل فضا معرفی می کند.

this article reteracted by author, because she used a text of other article without refrences. the speed of technology growth in all fields, including space exploration, has caused countries to try to update treaties and agreements related to that field. in this regard, we can refer to the commercial space launch competitiveness act of 2015, law of july 20th 2017 on the exploration and use of space resources and finally the artemis accords, which was adopted in october 2020 by 32 countries. the artemis accords is part of the broader artemis program led by the us national aeronautics and space administration (nasa). the question that must be answered in this article is whether artemis accords can affect the development of international space law? the writing method used in this article is the documentary method. this article examines the compliance of the artemis accords with international laws and standards. also, while this accord is rooted in the provisions of the outer space treaty, it introduces a significant innovation in international space law by replacing the predictive approach to regulate space activities.
