تعقیب و مجازات صلح‌بانان سازمان ملل متحد در قبال ارتکاب جرم خشونت جنسی علیه زنان

در فرآیند عملیات حفظ صلح سازمان ملل و در حین گذراندن ماموریت صلح‌بانان در سرزمین‌های جنگی و اشغالی؛ ممکن است جرائمی علیه زنان ارتکاب یابد که مستلزم پیگیری و تعقیب باشد. از طرفی باید توجه داشت که زنان و کودکان با توجه به شرایط‌ ضعیف جسمانی، زودتر در معرض بزه دیدگی ازجمله بزه‌دیدگی جنسی قرار می‌گیرند. با توجه به گزارش‌ها زیادی که از طریق قربانیان و بزه‌دیدگان جنسی زن به سازمان ملل متحد گزارش شده است، به نظر می‌رسد نیروهای صلح‌بان عملیات حفظ صلح سازمان ملل در شرایط بحرانی و جنگ‌زده، خطری جدید و جدی برای زنان و حتی کودکان دولت میزبان محسوب می‌شوند. لذا در این مقاله و از رهگذر روش توصیفی-تحلیلی در پی پاسخگویی به این پرسش کلیدی هستیم که تعقیب و مجازات صلح-بانان سازمان ملل در خصوص ارتکاب جرائم خشونت جنسی علیه زنان در اثنای عملیات حفظ صلح با چه چالش‌ها و موانعی مواجه است؟ یافته‌های مقاله‌ حاضر نشان می‌دهد که با توجه به ماده 7 اساسنامه رم امکان اِعمال صلاحیت دادگاه کیفری بین‌المللی نسبت به جرم خشونت جنسی علیه زنان توسط صلح‌بانان سازمان ملل با چالش‌ها و موانع اساسی روبرو است. در واقع وجه تمایز پژوهش حاضر نسبت به سایر پژوهش‌های مرتبط، کنکاش، یافتن و تحلیل دقیق ظرفیت‌های فعلی نظام حقوقی بین‌المللی برای تعقیب و محاکمه‌ مجرمین مذکور می‌باشد.

the pursuit and punishment of the un peacekeepers towards committing crime of sexual violence against women

in the process of un peacekeeping operations and in the process of conducting peacekeeping missions in war and occupied territories; crimes may be committed against women that require prosecution. on the other hand, it should be noted that women and children are exposed to victims, including sexual victims, due to their poor physical condition. according to numerous reports to the united nations through female victims and sex victims, un peacekeeping forces appear to be a new and serious threat to women and even to war. children in areas of the host state are considered. therefore, in this article and through the descriptive-analytical method, we seek to answer this key question: what challenges and obstacles does the prosecution and punishment of un peacekeepers for committing crimes of sexual violence against women during peacekeeping operations face? the findings of this article show that according to article 7 of the rome statute, the possibility of applying the jurisdiction of the international criminal court to the crime of sexual violence against women by un peacekeepers faces major challenges and obstacles. in fact, the distinction of the present research compared to other related researches is the exploration, finding and detailed analysis of the current capacities of the international legal system for the prosecution and trial of the mentioned criminals.
