حمایت از محیط زیست جنگل در مخاصمات مسلحانه بر پایه حقوق بشر بین الملل

جنگل‌ها به عنوان ریه تنفسی زمین نقش پررنگی را درتامین حق حیات بشرایفا می‌کنند و در پیوند ناگسستنی با  دیگرحقوق بنیادین بشر می‌باشند، جنگل‌ها به عنوان یکی از عناصر مهم محیط زیست طبیعی، تکمیل‌کننده زنجیزه حق بر داشتن محیط زیست سالم بشر می‌باشند و به علت ویژگی‌های منحصر به فردی که دارند نقش تعیین‌کننده‌ای در پیروزی و یا شکست کشورهای متخاصم در جنگ‌ها دارند و به این جهت طرفین متخاصم از جنگل به عنوان تامین اهداف خصمانه استفاده می‌کنند، لذا باید با تمام توان و بکارگیری همه ظرفیت‌ها و قابلیت‌های موجود نسبت حفظ آن اقدام نمود. این مقاله در صدد است تا با واکاوی اسناد مختلف بین‌المللی مخصوصا  در مورد چگونگی ارتقای روند حفاظت از منابع زیست محیطی جنگل با استفاده از توانمندی نهادهای بین‌المللی برای شکل‌گیری عزم جهانی  به این پرسش اساسی پاسخ دهد که چگونه می‌توان زمینه حفاظت از محیط زیست جنگل را در زمان مخاصمات مصلحانه فراهم نمود؟ مقاله با روش توصیفی و تحلیلی، با هدف حفاظت از جنگل‌ها نگاشته شده است. نتایج کلی آن نشان می‌دهد هر روز بر دامنه جنگ‌ها افزوده می‌شود و به همین میزان یکی از منابع زیست محیطی که در خطر واقعی تخریب و انهدام هستند و از دامنه آنها کاسته می‌شود جنگل‌ها هستند، بنابراین باید با ایجاد ساختار مناسب همراه با الزامات قانونی برای تضمین این نعمت خدادادی که به عنوان مقدمه بهره‌مندی ازحق حیات بشر لحاظ می‌شود، اقداماتی هماهنگ در پیش گیرند.

forests, as the respiratory lung of the earth, play a significant role in the realization of the right to life, and are inextricably linked with other fundamental rights of mankind; forests, as one of the important elements of the natural environment, complete the right to a healthy human environment. and because of their unique characteristics, they have a decisive role in the victory or failure of hostile countries in the wars, and as a result, hostile parties use the forest as providing hostile aims, so they must be fully utilized and utilized. all existing capacities and capabilities are in keeping with it. every day, the size of the wars increases, and equally one of the environmental resources that are at the true risk of destruction and falling from their scope are forests, so it must be created by building a proper structure with legal requirements to guarantee this godgiven blessing which is considered as an introduction to the enjoyment of human rights, takes coordinated action. this paper seeks to answer the question of how to protect the environment by exploring different international documents, in particular on how to promote the conservation of forest ecosystem resources using the ability of international institutions to formulate a global resolve. provide the forest environment at a time of volatile conflicts?
