حق بر سلامت و تحریم‌های آمریکا در دوره ترامپ بر علیه جمهوری اسلامی ایران؛ با تاکید بر تحریم‌های دارویی و تجهیزات پزشکی

پس از پایان جنگ جهانی دوّم، قالب تغییرات، جهان را به سمت گسترش همکاری ها، سوق داد. منشور ملل متحد ضمن تعیین راهکارهای مختلف برای ایجاد صلح، اشاره گسترده ای به واژه حقوق بشر کرد و آن را تبدیل به گفتمانی نمود، که در جامعه جهانی، رعایت آن می‌تواند به عنوان عامل مهّمی در مقبولیت عمومی یک کشور تلقی شده و تا بدان جا اهمیت یافت که تمامی سازوکارهای بین المللی می‌بایست مطابق آن باشد. در این بین چارچوبه تحریم‌ها در قوانین سازمان ملل مشخص شده و منشور ملل متحد به صراحت تحریم‌هایی را که موجب نقض حقوق بشر می‌شود، نقض می‌کند. در حالیکه بر خلاف این موضوع، آمریکا با ایجاد تحریم‌های یک‌جانبه علیه ایران، موجب بسته شدن راه‌های سیاسی و اقتصادی، خرید دارو، مواد اوّلیه دارویی و تجهیزات پزشکی شده است. هدف مقاله آن است که به نقش تحریم‌های آمریکا در نقض سلامتی مردم ایران بپردازد. این پژوهش با رویکردی توصیفی تحلیلی به دنبال دستیابی به این پرسش است که تحریم‌های آمریکا در حوزه دارویی و تجهیزات پزشکی چه پیامدهایی بر سلامت مردم ایران داشته است؟ یافته‌های پژوهش حاکی از آن است که، هر چند بر روی کاغذ، اقلام دارویی و تجهیزات پزشکی جزو اقلام بشردوستانه بوده و نمی‌بایست در ردیف تحریم‌ها قرار گیرند اما آمریکا با اتخاذ تحریم‌های یک‌جانبه موجبات تحریم دارو و تجهیزات پزشکی را فراهم کرده و از این طریق به نقض حقوق بین الملل و قواعد حقوق بشری مبادرت نموده و بدین شکل موجب تضییع حق بر سلامت مردم ایران شده است.

since the end of world war ii, global developments have driven the world to expand collaborations. in addition to providing various solutions to peace, the charter of the united nations has made an extensive reference to the “human rights” and transformed this term into a discourse, the global compliance with which can be considered an important factor in the public acceptance of a country. this term has gained so much importance that all international mechanisms should be developed accordingly. in this regard, specific frameworks have been defined for sanctions in the un laws, and the charter of the united nations will explicitly revoke the sanctions that violate the human rights. conversely, the us has deprived iran of both political and economic relations and obstructed its right to purchase drugs and medical equipment by imposing unilateral sanctions against this country. this paper aims to analyze the effects of the us sanctions on the violation of iranian people’s right to health. for this purpose, a descriptiveanalytical approach is employed to determine what impacts the us sanctions have had on iranian people’s health in pharmaceutical and medical areas. although drugs and medical equipment are officially considered humanitarian items and should not be sanctioned, the research findings indicate that the us has imposed unilateral sanctions on these items. hence, it has violated the international laws and human rights, thereby adversely affecting iranian people’s right to health.
