اثر همه‌گیری کرونا بر چشم انداز تعهدات بین المللی کشورها در حوزه سلامت

اگر چه مطابق اسناد بین‌المللی حق ‌برسلامت همواره تعهدی ملی محسوب شده و فاقدالزامات بین‌المللی است، ولی خطر روزافزون بیماری‌های فراگیر می‌تواند موجب اثرگذاری فرامرزی عدم تحقق مناسب حق مذکور شود. دغدغه‌ای که موجب تبدیل خطر شیوع همه‌گیری به تهدیدی جهانی می‌شود. در چنین چشم اندازی، آیا دامنه تاثیر فرامرزی همه‌گیری‌ها خواهد توانست سبب ارتقای تعهدات حق ‌برسلامت به سطح بین‌المللی شود؟ برای پاسخ به این پرسش، با بررسی فرآیند توسعه تعهدات بین‌المللی کشورها، ذیل صلاحیت شورای ‌امنیت سازمان ‌ملل ‌متحد، نخست با روشی توصیفی تفسیر امنیتی از تحقق نیافتن مناسب حق ‌برسلامت ارائه خواهیم داد. سپس با تحلیل آماری درخصوص قربانیان ابولا و کرونا، درپی اثبات مفروض افزایش سطح نیازعینی به تفسیر جدی‌تر از تعهدات بین‌المللی خواهیم پرداخت. درمجموع، با آن‌که مشکل تفاوت نگرش‌ها و رقابت میان قدرت‌های جهانی همچنان وجود دارد، اما تشدید ابعاد مختلف خطر همه‌گیری‌ها درسطح بین‌المللی، جامعه جهانی را ناگزیر به پذیرش تعهدات جدی‌تر دراین حوزه خواهد نمود.

The Impact of the COVID-19 Pandemic on the Outlook for International Health Commitments

Although, according to international instruments, the right to health has always been a national obligation and lacks international requirements, the growing risk of communicable diseases can have a transboundary impact on the inadequate realization of this right. A concern that might make a pandemic outbreak a global threat. Thus, will the transnational impact of pandemics enhance the level of health obligations from national to international? To answer this question, by examining the developing process of countries’ international obligations, under the authority of the United Nations Security Council, we will first assess the security interpretation of inadequate realization of the right to health. Then, by comparing the statistics of Ebola and corona victims, we will try to prove the need for a more objective need for a serious interpretation of international obligations. In conclusion, although there are differences in attitudes and rivalries between world powers, the escalation of the various dimensions of pandemics at an international level will force the international community to accept more serious commitments in this area.
