حبس زدایی سلامت‌محور؛ برآیند سلامت و عدالت در رویکرد نظام حقوقی ایران و اسناد بین‌المللی حقوق بشر

با توجه به این‌که بسیاری از متهمان و محکومان پیش از ورود به زندان بیمار بوده و یا در دوران تحمل کیفر دچار بیماری می‌شوند و شرایط محیطی خاص زندان‌ها بر سلامت ساکنان آن تاثیر دارد لذا نیازمند توجه ویژه است. از سویی نیز، در کنار لزوم رعایت عدالت یافتن راهکار مناسب در راستای کاهش جمعیت کیفری زندان‌ها امری ضروری است؛ بنابراین، هدف از این پژوهش، تبیین جایگاه حبس زدایی سلامت‌محور در رویکرد نظام حقوقی ایران و اسناد بین‌المللی حقوق بشر می‌باشد. ازاین‌رو، پژوهش حاضر با بررسی رویکرد نظام حقوقی ایران و اسناد بین‌المللی حقوق بشری بر حبس زدایی سلامت‌محور، درصدد پاسخ به این پرسش است که حبس زدایی سلامت‌محور چه تاثیری در فرآیند عدالت کیفری دارد؟ روش تحقیق استفاده شده در این پژوهش از نوع توصیفی و تحلیلی می‌باشد. پژوهش حاضر به این نتیجه رسیده است که یکی از جلوه‌های حبس زدایی سلامت‌محور، بازنگری و تعدیل در سیاست‌های ناظر بر حبس و مدیریت زندان‌ها است. لذا، سیاست‌های جنایی باید حاصل پیوند سلامت و عدالت بوده و می‌توان گفت که حبس زدایی سلامت‌محور، در کنار توجه بر سلامت زندانیان، روند گرایش به کیفرهای جامعه مدار را تقویت می‌کند.

Release from Health-Oriented Prison: Outcome of Health and Justice in Iran’s Legal System and International Human Rights Instruments

Many defendants and convicts might be ill before entering a prison or might became ill during a sentence. Some environmental conditions of prisons may also affect the health of inmates; therefore, special attention must be paid to the matter. In addition to the need to observe justice, it is essential to formulate an appropriate strategy for reducing the criminal population of inmates. Therefore, this study aims to address the status of healthoriented deprivation of liberty in Iran’s legal system and international human rights instruments. Analyzing the healthoriented imprisonment approach in Iran’s legal system and international human rights instruments, this study seeks to determine what effects healthoriented imprisonment has on the criminal justice process. In fact, this descriptive analytical study concludes that a manifestation of healthoriented deprivation of liberty is the review and adjustment of policies governing imprisonment and prison management. Hence, criminal policies should result from the link between health and justice. Moreover, analysis of healthoriented deprivation of liberty and attention to the health of inmates can strengthen the trend in communitybased punishments.
