تورم جمعیت کیفری زندان‌ها و نقض مقررات بین‌المللی حقوق بشر؛ علت‌ها و راهبردها

بزهکاری ناشی از عوامل ساختاری و اجتماعی است که زندان در از بین بردن آن ها تاثیری ندارد و تا زمان وجود علل و زمینه‌های بزهکاری در جامعه، زندان ها هم با ازدحام جمعیت کیفری مواجه خواهند بود. لذا سوال اصلی این است که تورم جمعیت کیفری زندان ها ناشی از چه عواملی بوده و رعایت کدام راهبردهای اسناد بین المللی حقوق بشری می تواند در مدیریت آن تاثیرگذار باشد؟ تحقیق حاضر به روش توصیفی و تحلیلی و بر پایه اسناد و منابع کتابخانه‌ای نگاشته شده است. بر اساس یافته های این پژوهش، حبس محور بودن قوانین، استفاده گسترده قضات از حبس و فراهم نبودن امکانات استفاده از فناوری‌های نوین از جمله دستبندها و پابندهای الکترونیک، از دلایل مهم تورم جمعیت کیفری زندان‌ها شناسایی شده اند که مقررات بین المللی حقوق بشر زندانیان را نقض می نمایند. نتیجه اصلی این که راهبردی جامع و چند رشته ای به منظور تبیین و مقابله با آن، برابر استانداردهای بین المللی لازم است. لذا این مقاله بر آن است تا عوامل موثر بر تورم جمعیت کیفری در زندان های ایران را از منظر آموزه های علوم جنایی تجربی با تکیه بر راهبردهای حقوق بین الملل بشر در مدیریت جمعیت کیفری بررسی نماید.

Criminal Population Inflation of Prisons and Violation of International Regulations of Human Rights; Causes and Strategies

Delinquency arises from structural and social factors that the prison has no effect on eliminating and as long as there are causes and grounds for delinquency in society, prisons will also face a crowded criminal population. Therefore, the main question is what caused the criminal population inflation of prisons and observation which strategies of international human rights documents can be effective in managing it? The present research has been written in a descriptive and analytical method and based on library documents and sources. According to the findings of this research, imprisonmentbased laws, judges’ widespread use of imprisonment and lack of facilities to use modern technologies, including bracelets and fasteners electronic, have been identified as important causes of criminal population inflation of prisons in Iran, which violate international regulations of human rights for prisoners. The main result is that a comprehensive and multidisciplinary strategy is needed to explain and counter it, in line with international standards. Therefore, this paper aims to review the factors affecting the criminal population inflation in Iran prisons from the perspective of experimental criminal sciences doctrines relying on international human rights law strategies in the management of the criminal population.
