مسئولیت سازمان ملل متحد برای فعل‌های مغایر با موازین بین‌المللی (بررسی تفصیلی گزارش شورای حقوق بشر سازمان ملل در خصوص جنگ غزه)

در 23 ژوئیه سال 2014، شورای حقوق بشر طی قطعنامه s21/1، تصمیم به اعزام فوری کمیته مستقل تحقیق در خصوص جنگ غزه، برای ایجاد حقایق و تخلفات و جرایم مرتکب شده گرفت. چارچوب هنجاری برای کمیته تحقیق، حقوق بین الملل به ویژه قوانین حقوق بشر، حقوق بشردوستانه بین المللی و قوانین کیفری بین المللی می باشد. مقاله حاضر به بررسی گزارش منتشر شده، تجزیه و تحلیل مسئولیت سازمان ملل متحد و چگونگی عملکرد و اقدام موثر جامعه بین المللی در برابر فعل های مغایر با موازین بین المللی در این جنگ خواهد پرداخت. پرسش اصلی عبارت است از: سازمان ملل متحد و نهادهای وابسته به آن چه مسئولیتی در برابر جنگ 2014 غزه به عنوان فعلی مغایر با موازین حقوق بشری داشته و چه تاثیری می تواند بر موارد مشابه داشته باشد؟ فرضیه مورد آزمون: مسئولیت سازمان ملل متحد و نهادهای وابسته به آن برای فعل های مغایر با موازین بین‌المللی از جمله جنگ 2014 غزه، 1) بررسی حقایق و تخلفات بین المللی، 2) ارائه گزارش در خصوص جرایم ارتکابی و 3) ترغیب جامعه بین المللی برای اقدام موثر و ملزم ساختن مسببین و مسئولین در برابر جرایم ارتکابی می باشد.عدم اقدام موثر جامعه بین المللی، زمینه را بیش از پیش برای انجام فعل های مغایر با موازین بین‌المللی در قالب بی ثباتی، نقض حقوق بشر و عدم پاسخگویی فراهم می آورد.

UN Responsibility towards Actions against International Regulations (Comprehensive Study of UN Human Rights Council on Gaza War)

According to the resolution S21/1 on 23 January 2014, human rights council decided to send independent committee in order to investigate on Gaza war and its crimes. International law especially human rights, humanitarian law and criminal law have been normative framework of investigating committee. Therefore, this article is to study the published report, to analyze how international society deals with actions against international regulations in the war and also responsibility of UN. Accordingly the main question of the article is: what is responsibility of UN and related institutions towards crimes against human rights committed in Gaza war and also how actions of institutions may affect similar events in the future? Provisional answer may be that responsibilities of UN and related institutions toward actions against international regulations including Gaza war of 2014 are: 1) to investigate facts and international violations, 2) to report committed crimes, 3) to persuade international society to take effective action and enforce responsible authorities to accept responsibility of crimes they have committed. Lack of effective actions prepares the situation for further actions against international regulations which leads to instability, human rights violation and international irresponsibility
