چکیده
|
مفهوم مراقبت مقتضی و همچنین گسترهی تعهداتی که این قاعده حقوق بینالملل دربرگیرنده آن است امروزه یکی از مباحث موثر و چالشبرانگیز به شمار میآید. کارآمدی این قاعده در عرصههای مختلف حقوق بینالملل همچون حقوق بشر، حقوق بشردوستانه، حقوق بینالملل اقتصادی، حقوق مسئولیت بینالمللی، حقوق محیط زیست و دیگر زمینههای حقوق بینالملل سبب شده است نگاشتههای متعدد و تحقیقات فراوانی بَر گِرد این مفهوم صورت گیرد.مقاله حاضر پس از بررسی مفهوم مراقبت مقتضی اختصاصاً این ضابطه را در نظام بینالملل حقوق بشر مدنظر قرار داده و به این مساله محوری پرداخته است که مراقبت مقتضی در مقایسه با تعهدات سهگانهی دولتها در قبال حقوق بشر (تعهد به رعایت، حمایت و ایفا) از چه جایگاه و کارکردی برخوردار است. از آنجایی که مراقبت مقتضی را میتوان عمل با نهایت دقت، اهتمام و توجه مداوم در انجام تعهدات عرفی و قراردادی دانست، همافزایی این تعهد با سهگانه بشری دربرگیرنده هر سه تعهد به رعایت، حمایت و ایفاست. تنها بخشی از تعهدات سلبی دولت ذیل تعهد به رعایت از همافزایی با ضابطه مراقبت مقتضی استثنا شده است. بنابراین ضابطه مراقبت مقتضی در تار و پود تعهدات حقوق بشری دولتها تنیده شده و تنها مسیری است که نظام بینالملل حقوق بشر با طی آن میتواند به نظامی با حداکثر پاسخگویی و حقوق انسانی ارتقاء یافته تبدیل شود.

Abstract
|
currently, “due diligence” and its obligations are considered influential and controversial issues in international law. the efficiency of this principle in various fields of international law, such as human rights, humanitarian law, international investment law, state responsibility, environmental law, etc., has sparked many papers and research on it.this article is dedicated to a comprehensive exploration of the ’due diligence’ principle, with a specific focus on its position within the international human rights system. it also endeavors to delineate the principle’s relationship with the three key obligations of states in the context of human rights: respect, protect and fulfill.on the grounds that due diligence can be considered as the continuous attention to carefully fulfill treaty and customary obligations, its synergy with the three human rights principles leads to the fulfillment of the three aforementioned state obligations. each human rights duty is divided into three parts: the obligation to respect, protect, and fulfill. except for duty of omission, none of the commitments will be basically fruitful or will not reach the desired result without due diligence. as a result, it can be claimed that due diligence is at the heart of the international human rights system.
