سنجش نظریه جدایی چارهساز در پرتو مکاتب فلسفی حقوق بینالملل: آوردگاه حقوق طبیعی و پوزیتیویسم حقوقی

چکیده
|
نظریه جدایی چارهساز، که در بستر حق تعیین سرنوشت خارجی گروههای واجد وصفِ «مردم» پدیدار میشود، از مناقشهبرانگیزترین مفاهیم نوپدید در عرصه حقوق بینالملل عام و نظام بین المللی حمایت از اقلیتها بهطور خاص بهشمار میرود. با بررسی دیدگاههای موافقان و مخالفان این نظریه، میتوان رد پای مکتبهای فلسفی حقوق بینالملل و بهطور مشخص دو مکتب حقوق طبیعی و پوزیتیویسم حقوقی را در علت موافقت یا مخالفت با آن پیگیری کرد. موافقان این نظریه را میتوان در صف باورمندان به مکتب حقوق طبیعی و اصول بنیادین آن قرار داد و مخالفان آن را در شمار پیروان مکتب پوزیتیویسم حقوقی محسوب نمود. باورمندان مکتب حقوق طبیعی، با گشودن راه ورود و تاثیر ارزشها و اصول اخلاقی به حقوق بینالملل، نظریه جدایی چارهساز را بهعنوان آخِرین راهکار برای نجات مردمان تحت ستم در برابر حکومتی خودکامه، مجاز و مشروع میشمارند. این درحالی است که دنبالهروان مکتب پوزیتیویسم حقوقی، با تاکید بر اراده و منافع دولتها، این نظریه را در چارچوب حقوق موضوعه و حقوق بینالملل کنونی که عموماً و عمدتاً مبتنی بر رضای دولتهاست، مردود میانگارند. در این مقاله، نگارندگان سر آن دارند تا با به کارگیری شیوه توصیفی تحلیلی و با تکیه بر کتابها و مقالههای مرتبط، نظریه جدایی چارهساز را در پرتو دو مکتب فلسفی حقوق بینالملل یعنی مکتبهای حقوق طبیعی و پوزیتیویسم حقوقی، به سنجش درآورند.

Abstract
|
rst, emerging in the framework of the external right to self determination of groups characterized as people, is among the most controversial newly developed concepts in international law in general and international minority rights law, in particular. by examining the views of this theory’s proponents and opponents, the footprints of philosophical schools of international law, particularly the two schools of natural law and legal positivism, are seen behind the arguments made by the proponents and opponents. proponents of this theory can be classified as the adherents of the natural law school and its fundamental principles. its opponents are considered to be followers of the legal positivism school. opening the door for entrance and influence of moral values and principles to international law, the adherents of natural law theory regard rst as a last resort for saving the oppressed against an oppressive state and deem it permissible and legitimate. the legal positivism school’s followers, emphasizing the will and interests of states, reject this theory in the framework of positive law and contemporary international law, which is generally and mainly based on the state’s consent. employing a descriptive analytical method and relying on the related books and articles, this study aimed to assess the rst in the light of natural law and legal positivism schools.
