چکیده
|
موضوع تغییراقلیم و پیامدهای مخرب آن امروزه یکی از ابرچالشهای جهانی تلقی میشود. برای مقابله با آن راهکارهای عملی گستردهای اعم از ملی و بینالمللی در دست اجراست. یکی از مسائل کلیدی در این روند، امکان دادخواهی علیه موارد سوءعملکرد یا ترک فعلهای مخرب دولتها یا سایر بازیگران در عرصه جهانی است. فعالین مختلف با تقویت پیوندهای حقوقی پیامدهای تغییراقلیم با حقوق بشر در تلاش هستند تا ظرفیتهای قضایی یا شبه قضایی ملی یا بینالمللی برای رسیدگی به موارد دادخواهی تغییراقلیم را ارتقا بخشند. اینکه در روند تلاشهای مزبور، از حیث نظری چگونه پیوندهای تغییراقلیم با حقوق بشر توجیه میشود، از چه سازوکارهایی برای دادخواهی بهره میبرند و رویه سازوکارهای قضایی یا شبهقضایی مختلف در این زمینه با چه ویژگیهایی همراه بوده و چگونه موانع فنی فراروی دادخواهی را مرتفع ساخته و نهایتا چشم اندازهای آتی در این زمینه را چگونه میتوان ارزیابی کرد؟ محورهای اصلی پژوهش حاضر هستند که با روش توصیفی تحلیلی و ابزار کتابخانهای و مطالعه اسناد مختلف از جمله رویههای قضایی و شبهقضایی ذیربط و با استقراء دادههای متنوع برای استنتاج نتایج کلی و قابل تعمیم انجام پذیرفته است. دستآورد پژوهش بر ظرفیت بالای رویکرد حقوق بشر محور، در رابطه با دادخواهی از مسببان تغییر اقلیم تاکید دارد.

Abstract
|
climate change and its destructive consequences are considered as one of the major global challenges today. various measures are being taken to tackle this issue. a key issue in this process is the possibility of litigation against harmful actions or inactions by governments or other actors on the global stage. activists from different areas are working to enhance the capacity of national and international judicial and quasi judicial bodies to address climate change litigations by strengthening the legal relationship between climate change consequences and human rights. therefore, this research examines how, from a theoretical perspective, the relation between climate change and human rights is justified, what mechanisms are being utilized for litigation, what characteristics judicial and quasi judicial proceedings have in the context, how technical barriers to litigation are overcome, and ultimately, how the prospects in this area can be evaluated. these are the main topics of the present research, utilizing library tools and studying various documents, including relevant judicial and quasi judicial practices, and inferring generalizable conclusions from diverse data. the research findings underscore the high capacity of a human rights based approach concerning litigation against the perpetrators of climate change and the potential impact of these findings on future climate change litigation.
