تحریم‌های اقتصادی یکجانبه آمریکا و نقض حقوق بشر اتباع ایران

تحریم‌های یکجانبه آمریکا علیه ایران که با هدف تغییر رفتار یا تغییر نظام سیاسی جمهوری اسلامی ایران وضع و اجرا شده، به‌طور مستقیم و غیرمستقیم منجر به نقض حقوق بشر ایرانیان شده است و به‌ویژه بهره‌مندی آنان از حقوق اقتصادی را با چالش مواجه کرده است. پژوهش توصیفی – تحلیلی حاضر درصدد پاسخ به این پرسش است که بر اساس کدام مبانی می‌توان دولت ایالات متحده را به رعایت حقوق بشر ایرانیان در وضع تحریم‌های یکجانبه متعهّد دانست. اثبات این تعهد از آنجا ضرورت دارد که مسئولیت بین‌المللی دولت، منوط به شرایطی از جمله اثبات وجود تعهد و سپس نقض آن است. یافته‌های تحقیق نشان می‌دهد در خصوص ایرانیان مقیم ایران، این تعهدات جنبه فراسرزمینی دارند و به‌ویژه شامل نقض تعهد به احترام و همکاری بین‌المللی می‌شوند. در خصوص ایرانیان مقیم آمریکا نیز دولت آمریکا متعهّد به احترام و رعایت این حقوق در قلمرو خود است و در ارتباط با ایرانیان مقیم کشورهای ثالث، آمیزه‌ای از تعهدات فراسرزمینی آمریکا و تعهدات سرزمینی دولت‌های مقیم مطرح است.
