سربستگیحقوق بشر

حقوق بشر به عنوان مبنایی برای قوانین ملّی و فرا ملّی ونیز به عنوان مشروعیت بخشنده به فرآیندهای سیاسی در این دو سطح شناخته می‌شود. بعلاوه، اعتبار بسیاری از نظریاّت علوم انسانی بر اساس نسبتشان با حقوق بشر سنجیده می‌شود. این مقاله می‌کوشد نشان دهد علی‌رغم اینکه در این زمینه‌ها مفهوم حقوق بشر اغلب به گونه‌ای به کار می‌رود که گویی با مفهومی روشن و مورد اتفاق همگان مواجه هستیم، در واقع حقوق بشر هم از لحاظ مفهومی و هم از لحاظ مصداقی از سربستگی و ابهامات مبنایی رنج می‌برد. مادامی که این ابهامات گشوده نشده است، هرگونه بحث از حقوق بشر در عرصهٔ قانون، سیاست، اقتصاد و اجتماع بحث بی‌فرجامی خواهد بود و گشودن این ابهامات در گرو مطالعات فلسفی در حقوق بشر است.

سربستگی «حقوق بشر»

Human rights are of the basis for the local and international laws and bestow legitimacy on states. Furthermore, a vast number of theories in the field of humanities are evaluated based on their approaches to human rights. Despite widespread assumption that “human rights” is a clear and commonly accepted concept, in this article I show the opacity of human rights both conceptually and extensionally. Also, I explain that, as long as “human rights” is not clarified, the whole discussions on human rights in the fields of law, economics, politics and so on will be in vain, and the clarification of “human rights” is possible only under philosophical examination of this notion.
