بررسی تطبیقی توزیع و حقوق مالکیت منابع نفت و گاز در ایالات متحده آمریکا، مبتنی بر نظریه توزیع پیش از تولید اقتصاد اسلامی

زمین و ثروت‌های معدنی از سرمایه‌های هر کشوری محسوب می‌گردند که نوع توزیع و حقوق مالکیت حاکم بر آن‌ها نقشی مهم در روابط اقتصادی حاکم بر جامعه ایفا می‌کند. در این بین منابع نفت و گاز اهمیت ویژه‌ای داشته و نظام‌های حقوقی متفاوتی نیز بر مالکیت آن‌ها حاکم است. آمریکا کشوری است که از سازوکار توزیع مختص به اقتصاد سرمایه‌داری برخوردار و حقوق نفت و گاز در آن، به اعتراف برخی، یکی از شاخه‌های پیشرفته حقوقی است. از طرفی نظریه توزیع پیش از تولید اقتصاد اسلامی، به ابعاد اساسی و مختلفی از مالکیت منابع طبیعی پرداخته و از این طریق توانسته است مسیر تحقق عدالت در برخورداری از منابع و پیشرفت اقتصادی را مشخص کند. در این پژوهش، جهت مشخص‌تر شدن حقوق مالکیت منابع نفت و گاز و فهم بهتر نظام توزیع آن‌ها، سازوکار توزیع و حقوق مالکیت منابع نفت و گاز در آمریکا مبتنی بر نظریه توزیع پیش از تولید اقتصاد اسلامی، و با بهره‌گیری از روش تطبیقی، ارزیابی و مشخص شد که در چهار مولفه اساسی «مالکیت خصوصی»، «تابعیت مالکیت منابع از مالکیت زمین»، «تولید سرمایه‌دارانه» و «از بین رفتن فرصت بهره‌وری مردمی»، انتقادهای اساسی بر آن وارد است.

a comparative study of the distribution and property law of the oil and gas resources in united states, based on the theory of distribution before the production of islamic economics

land and mineral wealth are the part of capitals of each country that the type of distribution and property law of them plays an important role in the economic relations. specially, oil and gas resources have particular importance. the united states is a country that has a distribution mechanism that is special for the capitalist economy, and its oil and gas rights are, as some admittedly, one of the most advanced branches of law. on the other hand, the theory of distribution before the production of the islamic economy has devoted to various aspects of the ownership of natural resources. in order to clarify the property law of the oil and gas resources and to better understand their distribution system, the distribution mechanism and property law of oil and gas resources in u.s evaluated based on the theory of distribution before the production of the islamic economy by using an adaptive method. finally it was criticized in the &private property&, &citizenship ownership of resources from land ownership&, &capitalist production& and &loss of the opportunity for popular productivity& based on the above theory.
