تحلیل فقهی - حقوقی مبادله ارزهای قابل استخراج در اقتصاد اسلامی

یکی از موضوعاتی که با گسترش فناوری های فضای مجازی و بین‌المللی در راستای جهانی‌شدن مورد توجه قرار گرفته، پدیده ارز‌ مجازی و سازوکارهای مرتبط با آن است. این پدیده نشات گرفته از رشد فناوری به ‌نام بلاکچین و استفاده آن در فضای مجازی است. در این راستا با توجه به اهمیت مسائل شرعی و  گسترش تهدیدها و فرصت های پدیده های فضای مجازی و لزوم تعیین موضع مناسب در خصوص مبادله و معامله با این ارزها، به نظر می رسد مسئله شناخت دقیق ارزهای مجازی و تحلیل انواع آنها امری مهم و ضروری است. در این تحقیق سعی شده است اولاً با استفاده از روش های تاریخی، بنیادی و توصیفی ابعاد فنی، اقتصادی ارزهای مجازی تبیین شود، سپس بر اساس روش‌های معتبر فقهی اعم از فقه معاملات و فقه نظام مبتنی بر چارچوب اقتصاد اسلامی، حکم مبادله با ارزهای مجازیِ قابل استخراج (مانند بیت کوین) مورد تحلیل قرار گیرد. نتایج تحقیق نشان می دهد که اولاً انواع ارزهای مجازی با یکدیگر تفاوت ماهوی و حکمی دارند و ثانیاً ارزش ارز مجازی قابل استخراج خلق شده (مانند بیت کوین)، بر فرض وجود مالیت عرفی، از حیث عقلایی و شرعی قابل تعیین نیست؛ ثالثاً با گذشت زمان، تمرکز در استخراج و در نتیجه تمرکز ثروت در این مکانیزم خواهد شد که مخالف عدالت توزیعی ثروت خواهد بود.

This phenomenon stems from the growth of technology called blockchain and its use in cyberspace. In this regard, considering the importance of religious issues and the spread of threats and opportunities of cyberspace phenomena and the need to determine the appropriate position on exchange and dealing with these currencies, it seems that the issue of accurate knowledge of virtual currencies and its analysis It is important and necessary. In this research, first of all, it has been tried to explain the virtual and economic dimensions of virtual currencies by using historical, fundamental and descriptive methods., then based on valid jurisprudential methods, including Jurisprudence of transactions and Islamic jurisprudence based on the framework of Islamic economics ruling of exchange can be analyzed with extractable virtual currencies (such as bitcoin).The results show that, firstly, the types of virtual currencies are fundamentally different from each other, and secondly, the value of the extractable virtual currency (such as bitcoin) cannot be determined rationally and religiously, assuming the existence of customary taxation. Third, over time, the focus will be on extraction and, consequently, the concentration of wealth on this mechanism, which will be opposed to the distributive justice of wealth.
