ضرورت و الزامات قانون شفافیت در حوزه بودجه‌ریزی کشور

هدف اصلی مقاله حاضر تعیین و تبیین ضرورت و الزامات وجود یک قانون مستقل در خصوص شفافیت بودجه‌ریزی در کشور است. شفافیت حلقه مفقوده‌ای است که در منابع اسلامی بر وجود آن تاکید شده ‌است. برای این منظور با استفاده از روش اسنادی و تحلیل محتوا، تجربه کشورهای موفق در زمینه شفافیت بودجه‌ و قوانین مربوط به آن بررسی شده و ضعف شفافیت در نظام بودجه‌ریزی ایران مورد آسیب‌شناسی قرار گرفته و سپس با تطبیق وضعیت موجود ایران و وضعیت مطلوب دنیا  در ابتدا ضرورت تصویب یک قانون مستقل در زمینه شفافیت بودجه برای ایران سپس الزاماتی که باید در قانون شفافیت بودجه رعایت شود، استخراج شده است. اهمیت و ضرورت ارائه قانون مستقل را می‌توان این‌گونه عنوان کرد که شفافیت بودجه‌ای، درجه اعتبار بودجه را افزایش داده، هزینه‌های وام‌ستانی را کاهش داده و افزایش حمایت عمومی از سیاست‌های کلان اقتصادی را به همراه دارد؛ در نقطۀ مقابل، مدیریت غیرشفاف بودجه، ممکن است به بی‌ثباتی، ناکارایی یا تشدید نابرابری منجر شود. مهم‌ترین الزامات چنین قانونی را نیز می‌توان در تبیین نقش قانونی مجلس شورای اسلامی در تصویب و نظارت بر تامین مالی بودجه کل کشور، تبیین مسئولیت‌های دولت در قبال مدیریت و کنترل تامین مالی عمومی و تعیین سازمان‌های متولی و پاسخگو در حوزه تنظیم، اجرا و شفافیت و پاسخگویی سند بودجه خلاصه کرد.

Necessity and exigencies of budget transparency law for IRAN

The main purpose of this article is to determine the necessity and requirements of an independent law on budget transparency in Iran. Transparency is a missing link that has been emphasized in Islamic sources. For this purpose, using documentary method and content analysis, the experience of successful countries in the field of budget transparency and its related laws has been studied and the weakness of transparency in Iran’s budgeting system has been investigated and then adjusted to the existing situation of Iran and the favorable situation of the world is examined. The necessity of adopting an independent budget transparency law for Iran and the requirements to be met in the budget transparency law has been elaborated. Importance of transparency is because of increasing of budget trust and credibility, loan costs and public advocacy from macroeconomic policies. The most important requirements of such a law can also be described in explaining the legal role of the Islamic Parliament in approving and overseeing the financing of the country, in explaining the government’s responsibilities for managing and controlling public funding, and in designing and implementing regulatory and accountable organizations for the affairs.
