امکان‌سنجی فقهی ضمانت طرح‌های بازنشستگی با مشارکت معین

طرح‌های بازنشستگی با مزایای معین در حال حاضر با مشکلات و مسائل جدی مواجه‌اند که بقای آنها را دچار تهدید و منافع اعضا را با ریسک قابل توجهی روبه‌رو نموده است؛ ازاین‌رو در بسیاری از کشورهای دنیا از طرح‌های بدیل همچون طرح‌های بازنشستگی با مشارکت معین استفاده می‌شود.  ازآنجاکه سرمایه‌گذاری در این نوع طرح‌ها بسته به میزان درجه ریسک‌گریزی اعضا و با هماهنگی خود آنان صورت می‌پذیرد، بر خلاف طرح‌های با مزایای معین که ریسک سرمایه‌گذاری بر عهده بانی یا کارفرماست در طرح‌های با مشارکت معین، ریسک سرمایه‌گذاری بر عهده اعضای طرح می‌باشد. ازآنجاکه در برخی کشورها برای تضمین این نوع طرح‌های بازنشستگی اقداماتی انجام شده است، هدف از انجام این تحقیق «امکان‌سنجی فقهی ضمانت طرح‌های بازنشستگی با مشارکت معین در نظام بازنشستگی کشور» با استفاده از روش تحقیق الگوی اجتهاد چندمرحله‌ای می‌باشد. یافته‌های تحقیق درباره تضمین اصل و سود سرمایه‌گذاری طرح‌های بازنشستگی با مشارکت معین، اشاره به جواز تضمین اصل سرمایه یا همان آورده اعضای طرح‌ بازنشستگی توسط خود صندوق بازنشستگی یا شخص ثالث دارد که البته چنانچه این تضمین از سوی شخص ثالثی همچون صندوق ضمانت بازنشستگی باشد، ترجیح دارد.

Thus, in many countries of the world, alternative schemes such as pension plans with specific partnerships are used. Since investments in these types of projects depend on the degree of risk aversion of the members and in coordination with them, unlike schemes with certain benefits that the risk of investment lies with the sponsor or the employer, in the projects with a certain participation, the risk of investment lies with the members of the plan. . Since some countries have taken measures to ensure these types of pension plans. The purpose of this research is "Feasibility Study of Pension Guarantees with certain Participation in the Pension System of the Country", using the multistage ijtehad model research method. The findings of the research on the assurance of the principle and profitability of investment in pension plans with a specified participation refer to a guarantee of the capital principle, or the raising of members of the pension plan by the pension fund itself or a third party, which, if it is guaranteed by a third party, such as a pension guarantee fund, would prefer.
