مطالعه تطبیقی مدل های قانونی‌ سازی کانابیس (مسئله ها و تناقض ها)

هدف: هدف پژوهش حاضر بررسی چارچوب ها و مقررات حاکم بر قانونی سازی در کشورهای کانادا، اروگوئه و دو ایالت واشنگتن و کلرادو بود تا در پرتو این مطالعه تطبیقی درک عمیق ‌تری از الگوهای قانونی سازی و مسئله های همبسته با آن به دست آید. روش: برای انجام تحقیق از روش توصیفی تحلیلی و در واقع تحلیل تطبیقی استفاده شد. نوع پژوهش کیفی و ابزار گردآوری اطلاعات نیز مطالعه مقاله‌ ها، گزارش ها و قوانین مرتبط با قانونی‌ سازی بود. ‌یافته ها: نتایج مطالعه بیانگر آن بود که دولت‌ های مذکور تلاش کرده‌ اند تا سازوکارهای مختلفی را در زمینه الگوهای عرضه کانابیس، قیمت‌ گذاری، تعیین محدودیت سنی برای مصرف و غیره تدوین کنند. در این میان، اینکه دولت ‌ها در چارچوب بهداشت عمومی به سلامت مصرف‌ کنندگان اهمیت بیشتری داده‌ اند یا کاهش میزان مصرف و یا اینکه به‌ طورکلی درآمد زایی توجیه ‌‌کننده اصلی اجرای قانونی‌ سازی به شمار می ‌ رود یا خیر، مسائلی است که در این پژوهش به بحث گذاشته شد. نتیجه گیری: الگوی تجاری و الگوی دولتی به عنوان دو الگوی اصلی قانونی سازی کانابیس هر کدام مسئله های خاص خود را به همراه داشته و از این رو به نظر می رسد باید بر اساس انتظارات مشخص و همینطور با لحاظ مقررات‌گذاری های خاص این مدلها، اقدام کرد.

A Comparative Study of Cannabis Legalization Models (Issues and Contradictions)

Objective: The present study aimed to examine the frameworks and regulations governing legalization in Canada, Uruguay, and the two states of Washington and Colorado to gain a deeper understanding of legalization models and the related issues in the light of this comparative study. Method: To conduct the research, the descriptiveanalytical method, and in fact the comparative analysis, was used. The research was of qualitative type and the data collection tool was the study of articles, reports, and laws related to legalization. Results: The results of the study showed that the mentioned governments have tried to codify various mechanisms in the field of cannabis supply patterns, pricing, setting age limits for consumption, etc. In the meantime, whether governments have paid more attention to the health of consumers or reducing consumption in the context of public health, or whether revenue generation is generally the main justifier for implementing legalization or not, are issues discussed in this study. Conclusion: The business model and the government model, as the two main cannabis legalization models, have their own issues and therefore it seems that action should be taken based on specific expectations and in terms of specific regulations of these models.
