دلالت‌های اندیشه نهادی کامونز در تفکیک‌ناپذیری دو حوزه اقتصاد و حقوق

طیف مطالعه های صورت پذیرفته در حوزه اقتصاد و حقوق، دیدگاه های متعدد فکری را در برمی گیرد. نقطه عطف این مطالعه ها که زمینه را برای گسترش این رویکرد بیش از گذشته فراهم کرد، انتشار اندیشه های اقتصاد نهادی در این حوزه بود. در این میان، کامونز یکی از بنیانگذاران اقتصاد نهادی است که برای سال های متمادی اندیشه های نهادی او مورد توجه و تاثیرگذار بر اندیشمندان پس از خود بوده است. پرسش اصلی این است که رویکرد تحلیلی کامونز به مسائل و موضوعات اقتصادی وی چه دلالت هایی در حوزه حقوق و اقتصاد دارد؟ در این مقاله بر اساس روش تحلیل متنی و مطالعات اسنادی به این پرسش پرداخته می شود. نتیجه آنکه کامونز با بینش منحصر به فرد خود نسبت به مفهوم نهاد در قالب کنش جمعی توانست ضمن تغییر واحد تحلیل اقتصادی از کالا به مبادله، رویکرد جدیدی را که می توان از آن با عنوان رویکرد مبادلاتی یاد کرد، برای این حوزه از معرفت بشری به ارمغان آورد. رویکرد کامونز در خصوص شایع بودن تضادها در کنش های جمعی، توجه به عناصر حقوقی مبادله جهت تنظیم منافع و نظم در قالب طبقه بندی حقوقی و اقتصادی مبادلات و تشکل دایر به عنوان بستر انجام مبادلات، از نوآوری های بدیع اندیشه کامونز است.

The emergence of economic Institutionalism and legal arguments exchange and costs, on the other hand, using economic methods to analyze the laws and regulations in recent decades, has made this field of study more than before. Due to the importance of the ideas of Commons in this area, the explanation and analysis of the article is based on his ideas. As a result, Commons approach is based on his idea about the prevalence of conflicts, trying lawmakers and courts to resolve these conflicts, the evolution of rights as a consequence of the ongoing processes of conflict resolution and the going concerns as a the context of exchange.
