نگاهی به روند صدور بخشنامه‌ها و دستورالعمل‌های گمرکی و ضرورت تحول در آن

تعدد صدور بخش‌نامه‌های گمرکی طی سال‌های اخیر به‌ویژه پس از خروج آمریکا از برجام و تشدید تحریم‌ها بر علیه ایران، موجب اعتراض فعالان اقتصادی و تجاری کشور شده است. در این مطالعه ضمن بررسی همه بخش‌نامه‌های گمرکی از سال 1395 تا سه ماهه اول سال 1399 در قالب یک بانک اطلاعاتی، مفاد آنها با استفاده از روش تحلیلی- توصیفی از ابعاد مختلف بررسی و نتایج مورد تجزیه و تحلیل گرفت. نتایج حاکی است از میان 1210 بخشنامه موجود در سایت گمرک، تعداد 889 مورد (73 درصد) قابلیت ساماندهی در قالب سامانه‌های مختلف را دارند؛ به‌طوری‌که توصیه می‌شود 417 بخشنامه‌ مربوط به رویه‌ها و فرایندهای اداری گمرکی از سوی وزارت اقتصاد و دارایی (به‌طور خاص گمرک)، 250 بخش‌نامه ستاد مبارزه با قاچاق کالا و ارز مبنی بر تعیین واحدهای مجاز صادراتی محصولات نفتی و پتروشیمی، 63 بخش‌نامه تعیین شرایط قرنطینه‌ای محصولات کشاورزی توسط وزارت جهادکشاورزی، 69 بخش‌نامه از مصوبات ستاد تنظیم بازار در قالب سامانه‌های جداگانه ساماندهی شوند.

the frequent issuance of customs licenses in recent years and its increasing trend, especially in the last two years, simultaneously with the withdrawal of the united states from the un security council and the intensification of sanctions against iran, has caused protests from economic and trade activists. it seems that this procedure of issuing sections has been contrary to the measures taken to facilitate trade and the efforts made to implement the window of the business unit in order to create conditions to facilitate trade. due to the importance of the subject of this article, it has identified the disruptive areas of trade in customs directives and provided appropriate solutions to improve the disruptive areas of production and trade. this article is of research-applied type and using analytical-descriptive method, while forming a database of customs directives (for the period of 2016 to the first quarter of 1399), the provisions of each directive are examined from different dimensions and the results are analyzed. was analyzed.
