نقش هرمنوتیک در تفسیر قواعد حقوق بین‌الملل

یکی از ویژگی‌های قواعد حقوقی که پایه و مبنای نظام بین‌المللی می‌باشد، این است که به‌صورت کلی تدوین می‌شوند. این ویژگی کلی‌ بودن، اشکالات عمده و مستمر در اجرای قاعده به وجود می‌آورد. در حقیقت ممکن است کارکرد قاعده حقوقی در حل مسائل نظام بین‌المللی با مشکل مواجه شود. برای اینکه در هر مورد خاص که پیش می‌آید قاعده حقوقی بتواند درباره وقایع ملموس خارجی قابل اجرا باشد، یک کار تکمیلی لازم است و آن کار تکمیلی عبارت است از مشخص نمودن مفهوم قاعده و منطبق کردن آن بر موارد جزئی و جستجوی معنای خارجی آن قاعده. تنها به این طریق است که سکوت، ابهام، اجمال و نقص قانون برطرف شده و برای موارد مشخص و جزئی تعیین تکلیف می‌گردد، در غیر این صورت جامعه بین‌المللی با خلا حقوقی و قانونی مواجه می‌گردد. جستجوی معنای خارجی قاعده با اصطلاحاتی مانند تفسیر، تاویل و هرمنوتیک حقوقی شناخته می‌شود. پژوهش حاضر که به شیوه توصیفی تحلیلی و با استفاده از ابزار کتابخانه‌ای نوشته شده است، می‌کوشد نقش هرمنوتیک در تفسیر قواعد حقوق بین‌الملل را مورد بررسی قرار دهد. نتایج پژوهش نشان‌دهنده این است که می‌توان با اتخاذ یک روش هرمنوتیکی بر مبنای گزاره‌های هرمنوتیک مدرن در جهت رفع ابهام و تعارض در تفسیر قواعد حقوق بین‌الملل برآمد.

one of the fundamental characteristics of legal norms underpinning the international legal order is their formulation in general terms. this generality gives rise to persistent and significant challenges in their application to concrete cases. in practice, the efficacy of legal norms in addressing international disputes may be compromised due to indeterminacy. to ensure that legal norms can be applied to specific factual scenarios, a complementary process is indispensable. this complementary process involves elucidating the norm’s meaning, contextualizing its application, and ascertaining its normative intent. only through this approach can legal silence, ambiguity, generality, and lacunae be addressed, thereby providing definitive solutions to disputes; otherwise, the international community risks perpetuating legal and normative gaps. the search for a norm’s normative intent is encapsulated by terms such as interpretation, construction, and juridical hermeneutics. this descriptive-analytical study, employing library research methods, examines the role of hermeneutics in interpreting international law norms. the research findings demonstrate that adopting a hermeneutic approach grounded in contemporary hermeneutical theory can effectively resolve ambiguity and conflicts in interpreting international law norms.
