جایگاه مطلوب سازمان بازرسی و نقش مردم در نظارت در نظام حقوقی ایران

فربه شدن قوه قضائیه سبب شده است تا این قوه از انجام وظیفه ذاتی خود که رسیدگی به حل‌وفصل اختلافات است، دور شود. برای اینکه قوه قضائیه بتواند به سهولت به رسالت اصلی امر قضا بپردازد، مستلزم چابک‌سازی است. با برون‌سپاری وظایف غیرقضایی این قوه و نهادهای وابسته به آن، رسیدگی به اموری که دارای ماهیت قضایی است در این قوه به‌درستی صورت می‌پذیرد. به‌منظور چابک‌سازی قوه قضائیه، برخی از نهاد‌‌های وابسته به آن باید به‌منظور رعایت اصل صحیح ساختار اداری از ذیل این قوه خارج و برون‌سپاری شوند. یکی از نهادهای وابسته به قوه قضائیه بر اساس قانون اساسی، سازمان بازرسی است که وظیفه نظارت بر دستگاه‌‌های اجرایی را بر عهده دارد. در این مقاله سوال نگارندگان آن است که «جایگاه مطلوب سازمان در نظام حقوقی ایران کجاست و نقش مردم در نظارت چیست؟» سازمان بازرسی بازوی نظارتی قوه قضائیه است اما از آنجا که نظارت این سازمان بر دستگاه‌‌های اجرایی و اداری شامل دستگاه‌‌های قوه قضائیه نیز می‌‌شود، از این رو نظارت سازمان بر قوه قضائیه تقلیل یافته و به نظارت سلسله‌مراتبی تبدیل می‌‌شود. این امر باعث می‌‌شود تا نظارت به‌صورت دقیق و صحیح انجام نشود. این ایراد به قوای مقننه و مجریه در صورتی که سازمان بازرسی در زیرمجموعه آنها قرار گیرد، وارد است. لذا باید سازمان از زیرمجموعه قوه قضائیه برون‌سپاری و به زیرمجموعه نهاد رهبری اضافه شود و یا باید بر اساس مفاد مندرج در سند تحول قضایی از ظرفیت بخش خصوصی و همچنین نهادهای مردمی استفاده بهینه شود.

the desirable position of the inspection organization and the role of people in supervision in iran’s legal system

the fattening of the judicial branch has caused this branch to perform its inherent duty. in order for the judiciary to be able to deal with matters of justice easily, it requires agility. by outsourcing the non-judicial duties of this branch and its related institutions, dealing with matters of a judicial nature will be properly handled in this branch. some of its affiliated institutions should be outsourced from the organizational chart of this authority in order to comply with the correct principle of administrative structure. according to the constitution, one of the institutions related to the judiciary is the inspection organization, which is responsible for supervising the executive bodies.in this article, the authors’ question is that &where is the desired position of the organization in iran’s legal system and what is the role of the people in supervision?& the inspection organization is the supervisory arm of the judiciary, but since the supervision of this organization on the executive and administrative bodies also includes the judiciary, therefore the organization’s supervision of the judiciary is reduced and becomes a hierarchical supervision. this is a problem for the legislative and executive powers if the inspection organization is placed under them. therefore, the organization should be outsourced from the chart of the judiciary and added to the sub-group of leadership institutions, or the capacity of the private sector and public institutions should be optimally used based on the provisions contained in the judicial reform document.
