تولید و لزوم رعایت مقررات محیط زیست

تولید انبوه و متنوع، بارزترین چهره دنیای امروز است. تولید به‌رغم نقش مهم در توسعه، باعث تغییرات عمده اقلیم و آلودگی محیط زیست می‌شود. آلودگی محیط زیست، از مهم‌ترین بحران‌های جامعه امروز است؛ موضوعی که سرنوشت بشر را از بنیان متحول می‌کند و به حق انسان در دسترسی به محیط زیست سالم که از حقوق اساسی است، آسیب می‌رساند. آلودگی‌های ناشی از تولید، بیشتر به سبب فقدان استاندارد، بی‌کیفیتی محصولات و عدم کنترل است. آلودگی ناشی از تولید را هرگز نمی‌توان به صفر رساند؛ اما با اقدامات اساسی در زمینه تولید، می‌توان آن را به حداقل رساند. راهکارهای اصولی این است که در زمینه تولید، باید به اهداف بازدارندگی توجه کرد، استانداردهای سخت‌گیرانه تولید را به کار گرفت و استانداردها را نیز به‌روز کرد. تولیدات باید از مواد تجدیدپذیر و بر اساس استانداردهای محیط زیستی و در راستای توسعه پایدار ساخته شود. «عامل آلودگی» محیط زیست، به دلیل ایجاد منشا آلودگی و تعدی به حقوق دیگران، دارای مسئولیت مدنی است و باید زیان‌های به‌وجود‌آمده را جبران کند؛ زیرا حق برخورداری از محیط زیست سالم از حقوق اساسی انسان است و تولید آلاینده‌ به این حق آسیب می‌رساند. در نظام حقوقی ایران درباره مبنای مسئولیت مدنی، «نظریه تقصیر» ملاک است. این نظریه در زمینه مقابله با آلودگی محیط زیست با منشا تولید، کارایی لازم را ندارد. به‌علاوه، مطالبه خسارت‌های زیست‌محیطی بر مبنای این نظریه دشوار است. برای جبران کاستی این نظریه، «مسئولیت محض و استناد عرفی» برای کاهش آلودگی‌های محیط زیستی تولید و حمایت از محیط زیست می‌تواند موثر واقع شود.

mass and diverse production is the most obvious face of today’s world. despite production has important role in development, it causes major climate changes and environmental pollution. environmental pollution is one of the most important crises in today’s society, an issue that threatens the fate of mankind and harms the human right to a healthy environment, which is a fundamental right. pollution caused by production is mostly due to lack of standards, poor quality of products and lack of control. pollution caused by production can never be reduced to zero; but with basic action, pollution can be minimized. the basic solutions are that in the field of production, one should pay attention to the goals of deterrence, apply strict production standards and update the standards. products should be made from renewable materials based on environmental standards and in line with sustainable development. the &factor of pollution& of the environment, due to creating the source of pollution and violating the rights of others, has civil liability and must compensate for the resulting losses; because the right to access healthy environment is one of the fundamental human rights, and polluting production damages this right. in iran’s legal system, about the civil liability, the &fault theory& is the criterion. this theory is not effective for environmental pollution. also according to this theory, demand for environmental damage is difficult. for this reason &strict liability& and conventional citation can be effective to reduce the environmental pollution of product.
