آثار ارزهای مجازی در امنیت اقتصادی و حقوق شهروندی ایران

یکی از مهم‌ترین مسائل حقوقی روز، ابداع ارزهای دیجیتال به‌عنوان یکی از انواع ارزهای مجازی است. برای همگام‌سازی آن با تجارت بین‌‌المللی و جلوگیری از عقب ماندن کشور در مقایسه با سایر کشورهای منطقه و جهان، نیاز مبرم به‏ کاربرد این ارز در ایران احساس می‌‌شود. هدف از این پژوهش بررسی آثار ارزهای مجازی در امنیت اقتصادی کشور و همچنین تاثیرگذاری آن در حقوق شهروندی است. نتایج پژوهش بیانگر آن است که ارزهای مجازی (دیجیتال) در ابعاد امنیتی و اقتصادی چالش‏هایی را ایجاد کرده که این چالش‌ها باعث نقض مواد 34، 35، 71، 71 و 118 منشور حقوق شهروندی می‌شود و در نهایت به دلیل تخلفات و جرایم اجتماعی، فرار مالیاتی و پول‌شویی جزو اصلی‌ترین چالش‏های ارزی مجازی در سطح بین‌الملل هستند که مجلس شورای اسلامی با قانون‌گذاری صحیح و دقیق و مسئول قرار دادن سازمان‌ها و نهادهای دولتی به‌عنوان اجراکننده صحیح قوانین و نظارت بر آنان می‌تواند از این تهدید اقتصادی به‌عنوان فرصتی نو جهت رونق اقتصادی و افزایش امنیت اقتصادی بهره ایجاد کند. شایسته است سازمان امور مالیاتی کشور و شورای عالی مبارزه با پول‌شویی با تدوین مقررات کارآمد و اجرای آن و با نظارت شورای عالی فضای مجازی، پلیس فتا، نهادهای امنیتی و همکاری قوه قضائیه و دانشگاه‌ها در تدوین تولیدات علمی و حقوقی در این خصوص ابعاد مختلف حقوقی، شرعی، اجتماعی و سیاسی این موضوع را روشن نمایند تا از سوءاستفاده کلاهبرداران جلوگیری شود. روش پژوهش حاضر به‌صورت توصیفی تحلیلی است.

the impact of virtual currencies on economic security and citizens’ rights in iran

one of the most important legal issues of the day, the invention of digital currencies is one of the types of virtual currencies. there is an urgent need to use this currency in iran to synchronize it with international trade and prevent the country from falling behind compared to other countries in the region and the world. the purpose of this research is to investigate the effects of virtual currencies on the economic security of the country and also its influence on the rights of citizens. the results of the research show that virtual (digital) currencies have created challenges in terms of security and economy, which these challenges cause violation of articles 34, 35, 71, 72, and 118 of the charter of citizen rights, and finally, due to violations and social crimes, tax evasion, money laundering are among the main challenges of virtual currency at the international level, which the islamic council legislates correct and accurate and responsible for putting government organizations and institutions as the correct implementers of the laws and monitoring them can benefit from this economic threat as a new opportunity for economic prosperity and increasing economic security. and the supreme council for combating money laundering by formulating effective regulations and implementing them under the supervision of the supreme council of cyberspace, fata police, security institutions with the cooperation of the judiciary and universities in compiling scientific and legal productions in this regard, different legal and religious dimensions and social and political issues should be clarified and fraudsters should be prevented. the present research method is descriptive-analytical.
