بررسی سازکار نظارت بر اجرای سیاست‌های کلی نظام

سیاست‌های کلی نظام از جمله مواردی است که از سلسله‌مراتب هنجاری در نظام حقوقی جمهوری اسلامی برخوردار است. از این روست که سازکار پیش‌بینی‌شده جهت نظارت بر اجرای این سیاست‌ها در تعادل و انضباطی مستقیم قرار می‌گیرد. به همین دلیل سوالی که پدید می‌آید آن است که نوع نظارت ناظرین بر نحوه اجرای این سیاست‌ها از چه جنسی است؟ در همین راستا با توجه به اینکه مفهوم سیاست‌های کلی نظام، خاص نظام حقوق اساسی کشورمان است و فاقد مصداقی همانند در سایر کشورهاست، لذا در وهله نخست، ضرورت فهم و درک و سپس اجرای آن از اهمیتی دوچندان برخوردار است. اکنون در نظام حقوقی مورد بحث، بر اساس جزء (1-4) پیوست حکم دوره هشتم مجمع تشخیص مصلحت نظام، نهاد هیئت عالی نظارت بر حسن اجرای سیاست‌های کلی نظام به‌عنوان نهادی مستقل از مجمع تشخیص مصلحت نظام در کنار شورای نگهبان، نظارت بر حسن اجرای سیاست‌های کلی نظام را بر عهده گرفته است. این نهاد، مستقل از مجمع اما متشکل از اعضای مجمع است. بر این اساس نحوه نظارت بر اجرای سیاست‌های کلی نظام از ابتدای پیدایش این مفهوم در ساختار هنجاری کشورمان تاکنون جهت بهبود شیوه نظارتی در این نوشته مورد تامل و بررسی قرار خواهد گرفت. در نوشتار حاضر کوشش بر آن است تا با روش توصیفی تحلیلی و بر اساس داده‌های کتابخانه‌ای و اینترنتی نسبت به تبیین موضوعات مورد بیان در گزاره‌های فوق گام برداریم.

the general policies of the system are among those that have a normative hierarchy in the legal system of the islamic republic.this is why the predicted mechanism to monitor the implementation of these policies is placed in direct balance and discipline.therefore, the question that arises is, what kind of supervision is the supervisor on the implementation of these policies? in this regard, considering that the concept of the general policies of the system is specific to the constitutional rights system of our country and does not have a similar example in other countries, therefore, in the first place, the need to understand and then implement it is of double importance. now in the legal system under discussion, based on part (1-4) of the annex to the verdict of the 8th period of the council of expediency of the system, the institution of the supreme board of supervision of the implementation of the general policies of the system as an independent institution of the council of expediency of the system, alongside the guardian council, supervises the he has taken over the implementation of the general policies of the system. this institution is independent from the assembly but is formed by the members of the assembly. based on this, the way of monitoring the implementation of the general policies of the system since the beginning of this concept in the normative structure of our country until now, in order to improve the monitoring method, will be considered and examined in this article.
