بررسی مفهوم «توسعه مترقیانه حقوق» در نظام‌‌ حقوق بین‌‌الملل بشر و مقایسه آن با نظام حقوق بین‌‌الملل عام

حقوق بین‌‌الملل بشر دارای ویژگی‌‌هایی است که آن را از سایر رشته‌‌های حقوق بین‌‌الملل عمومی مجزا نموده است. این ویژگی‌‌های خاص سبب گردیده تا برخی واژگان مشترک، دچار تحول یا دگردیسی مفهومی شده و معنایی متفاوت از آنچه در حوزه حقوق بین‌‌الملل دارند را به ذهن متبادر نمایند. یکی از این واژگان «توسعه مترقیانه حقوق» است.خصیصه اعلامی بودن قواعد حقوق بشری (در تمامی انواع و اشکال قاعده اعم از عرف و معاهده) سبب گردیده که توسعه مترقیانه که در حقوق بین‌‌الملل مفهوم تاسیس و ایجاد حق را به ذهن متبادر می‌‌نماید، در حوزه موضوعی حقوق بین‌‌الملل بشر که تماماً از جنس شناسایی است، معنای ارتقای جایگاه و مقام و ترویج حقوق بشر را با خود به ارمغان آورد.مداقه در واژگان کلیدی و پرکاربردی چون «توسعه مترقیانه حقوق» و تشخیص و تبیین مفهوم دقیق آنها در حوزه موضوعی مورد بحث، این فایده را خواهد داشت که متعهدان قواعد حقوق بشری که در بیشتر موارد دولت‌ها هستند، ماهیت تعهدات و دامنه آنها را به‌درستی درک کرده و آنها را به نحو صحیح و مطابق با اهداف حمایت‌گرایانه حقوق بشر، به‌موقع اجرا گذارند.پژوهش حاضر به دنبال آن است که با تشریح ویژگی‌‌های حقوق بین‌‌الملل و حقوق بین‌‌الملل بشر، به این پرسش مبنایی پاسخ دهد که واژه «توسعه مترقیانه حقوق»، در حقوق بین‌‌الملل بشر چه تفاوت معنایی با این واژه در حوزه حقوق بین‌‌الملل عام دارد و واژگان جایگزین توسعه مترقیانه در حقوق بین‌‌الملل بشر چه هستند و چه معنایی را به ذهن متبادر می‌‌نمایند.

investigating the concept of “progressive development of law” in the system of international human rights law and comparing it with the general international law
