اثربخشی حسن نیت بر تحدید تعهدات با مطالعه تطبیقی حقوق ایران و قانون جدید فرانسه

در تعهدات عواملی وجود دارند که می‌توانند آن را تحدید نماید و سبب تغییر و یا سقوط آن شود. حسن نیت ازجمله عناصری است که می‌تواند تغییر تعهد را ایجاد نماید. در حقوق فرانسه سابقاً حسن نیت را صرفاً در اجرای تعهد موثر می‌دانست ولی با اصلاح قانون خود در سال 2016 آن را به مذکرات پیش از تعهد و ایجاد تعهد نیز تسری داد. حسن نیت در دو معنای عام و خاص به کار رفته است و آثار آن در تحدید تعهدات در معنای عام و خاص متفاوت است. آثار حسن نیت به معنای عام در نقش تصور اشتباه بروز می‌کند و در این راستا حقوق ایران و فرانسه شباهت‌ها و اختلافاتی با یکدیگر دارند و در معنای خاص به‌صورت نقص ارائه اطلاعات و یا عدم صداقت در رفتار متبلور است در این خصوص نیز حقوق ایران با حقوق فرانسه مسیر مشترکی نداشته و حتی در برخی موارد آن را مورد شناسایی قرار نمی‌دهد.
