چالش‌ها و ضعف‌های اصول راهنمای 2006 در مورد اعمال یک‌جانبه دولت‌ها در حقوق بین‌الملل

یکی از موضوعاتی که در دستور کار کمیسیون حقوق بین‌الملل در جهت تدوین و توسعه قرار گرفت، اعمال یک‌جانبه دولت‌ها بود. در دهه‌های اخیر دولت‌ها اعمال یک‌جانبه بسیاری در سطح بین‌المللی انجام داده‌اند. ازآنجایی‌که قواعدی برای شناخت و تعیین عناصر این اعمال در حقوق بین‌الملل معاصر وجود ندارد و از طرفی ضرورت قاعده‌مندی این اعمال در حقوق بین‌الملل، باعث شد که این موضوع به مدت ده سال در کمیسیون حقوق بین‌الملل مورد بررسی قرار بگیرد؛ و موضوعاتی از قبیل اینکه آیا اعمال یک‌جانبه دولت جنبه حقوقی دارد یا اعمال سیاسی را هم شامل می‌شود؟ یا اینکه عناصر عمل یک‌جانبه مستقل در حقوق بین‌الملل چیست و اینکه اعمال یک‌جانبه چه ارتباطی با دیگر قواعد حقوق بین‌الملل همچون حقوق معاهدات دارند؟ در کمیسیون مورد بررسی و بحث قرار گرفت که در نهایت پس از ده سال مطالعه و بررسی، کمیسیون مبادرت به تدوین اصول راهنما کرد که دارای نقاط چالش‌برانگیزی می‌باشد.

challenges and flaws of the 2006 guidelines on unilateral acts of states in international law

one of the issues incorporated in the international law commission agenda is “unilateral acts of states”. in recent decades, states have had many unilateral acts in the international level. absence of rules for identification of unilateral acts of states and their components according to international law, on the one hand, and importance of codification for such acts, on the other hand, have led to a prolonged analysis of them in the international law commission for one decade.questions such as whether unilateral acts of states only have legal aspects or also incorporate political acts; or what the elements of independent unilateral act in international law are; or what is the relationship between unilateral acts and other rules of international law such as the law of treaties; were discussed in the commission; and eventually, after ten years of study and analysis, the commission succeeded in codification of guidelines for this issue, which includes some challenging points.
