بررسی صلاحیت رسیدگی به بزه قاچاق ارز در حقوق ایران

موضوع قاچاق ارز، یکی از موضوعات بسیار مهمی است که در قانون مبارزه با قاچاق کالا و ارز مصوب 1392 نیز بدان توجه شده است و مبنای مبارزه با چنین پدیده‌ای را می‌توان مبارزه با فساد اقتصادی و حفظ امنیت اقتصادی عنوان نمود؛ در رابطه‌ با صلاحیت رسیدگی به بزه قاچاق ارز می‌توان دو نوع صلاحیت قضایی و غیر قضایی را موردبررسی قرار داد که درخصوص صلاحیت رسیدگی از نوع قضایی می‌توان دادگاه انقلاب و دادگاه عمومی را عنوان نمود؛ از جهاتی نیز سازمان شاکی، کاشف و تعزیرات حکومتی قرار دارند که به‌عنوان صلاحیت غیرقضایی درجهت رسیدگی به بزه قاچاق ارز، مطرح می‌باشند. سپردن قرار تامین، تحصیل دلایل قانونی و حق تجدیدنظرخواهی و اعتراض نیز ازجمله موارد آیین رسیدگی در شعب قضایی و غیرقضایی می‌باشد که در قانون، شرایط آن عنوان گردیده است.

Investigating the Jurisdiction of the Crime of Smuggling Currency in Iranian Law

Providing funding, studying legal grounds, and the right to appeal and protest are among the cases of proceedings in the branches of the judiciary and nonjudicial branches, which are stipulated in the law.
