آلودگی زیست‌محیطی ازطریق انتشار مواد هسته‌ای: راهبرد کیفری ایران و ایالات‌متحده آمریکا

انتشار مواد هسته‌ای در زمره جلوه‌های جرایم زیست‌محیطی می‌باشد که از ابعاد تروریستی و غیرتروریستی برخوردار است. دراین‌زمینه، کنشگران نظام حقوق بین‌الملل با تصویب کنوانسیون‌های حفاظت فیزیکی از مواد هسته‌ای و سرکوب اعمال تروریسم هسته‌ای به‌ترتیب در سال‌های 1979 و 2005، جرم‌انگاری ابعاد غیرتروریستی و تروریستی انتشار مواد هسته‌ای را در دستور کار قرار داده‌اند. در این خصوص، قانونگذار ایران در سال 1392، پخش مواد خطرناک در سطح گسترده را به‌عنوان یکی از مصداق‌های جرم حدی افساد فی‌الارض قرار داد. سوایِ استفاده از واژه‌ها و عبارت‌های ابهام‌آمیز، لزوم تحقق نتیجه مجرمانه و داشتن سوء‌نیت خاص باعث شده است تا پوشش ناقصی از حیث انطباق انتشار مواد هسته‌ای با حد افساد فی‌الارض به‌وجود آید؛ محاربه و تهدید علیه بهداشت عمومی در زمره جرایم دیگری هستند که هرکدام از چالش‌ها و نقص‌هایی در پاسخ به انتشار مواد هسته‌ای برخوردار هستند. در سوی مقابل، سیاست‌گذاران قانونگذاری فدرال ایالات‌متحده آمریکا به‌نحو روشن و کامل، جرم‌انگاری انتشار مواد هسته‌ای را در ابعاد تروریسم هسته‌ای و غیرِ آن، به‌صورت توامان مدّنظر قرار داده‌اند؛ با این اوصاف، در طی جستار حاضر تلاش بر آن است تا با بررسی مقررات ایران و ایالات‌متحده آمریکا، واکنش کیفری منسجم و متناسبی با اعمال یادشده موردترسیم قرار گیرد.

Environmental Pollution through the Dispersal of Nuclear Material: the Criminal Strategy of Iran and the United States

The dispersal of radioactive material is one of the environmental crimes that has both terrorist and nonterrorist dimensions. In this regard, the activists of the international law system with the ratification of the conventions on the physical protection of nuclear materials and suppression of acts of nuclear terrorism in 1979 and 2005, respectively, considered nonterrorist and terrorist dimensions of dispersal of radioactive material. In this way, the legislator of Iran in 2013, considered a wide range dispersal of hazardous substances as one of the instances of Efsadefelarz. In addition to the use of ambiguous words and phrases, the necessity of result of the criminal offense and special malice has led to incomplete coverage in terms of dispersal of radioactive material. Muharebeh and threats against public health are other crimes that have challenges and deficiencies in response to the dispersal of radioactive substances. On the other hand, US Federal Lawmakers have clearly and completely criminalized dispersal of radioactive material in both terrorist and nonterrorist dimensions. In the meantime, the purpose of this paper is to review the laws of Iran and the United States against dispersal of radioactive material and then introduce a proper criminal reaction about aforementioned act.
