تحلیلی بر سیر تحول مفهوم فرهنگ در نظام بین‌المللی حقوق بشر و تاثیر آن بر ارتقای حقوق فرهنگی

فرهنگ عنصر حیاتی زیست فردی و جمعی بشر بوده و حیات انسانی به آن وابسته است و بستر شکل‌گیری سامانه و سیره اخلاقی و حقوقی جامعه بشری است و بدون آن هیچ حقی قابل‌تعریف و تبیین نیست. این مفهوم در عرصه حقوق بین‌الملل، بیش از همه در نظام بین‌المللی حقوق بشر و گفتمان حقوق فرهنگی مطرح می‌گردد و در اسناد مختلف حقوقیِ بین‌المللی و در بیان‌های متفاوتی به‌کار رفته است. مقاله حاضر بر آن است تا به شیوه‌ای توصیفی تحلیلی و با روش گردآوری مطالب به‌صورت کتابخانه‌ای، به بررسی سیر تحول مفهوم فرهنگ در نظام بین‌المللی حقوق بشر و پیوند آن با ارتقای حقوق فرهنگی بشر بپردازد. این پویش نشان می‌دهد که از زمان تاسیس سازمان ملل متحد تاکنون، مفهوم فرهنگ سه تعبیر تکاملی را تجربه کرده است: فرهنگ به‌مثابه فرهنگ نخبگان، فرهنگ به‌مثابه فرهنگ عامه و فرهنگ به‌مثابه سبک زندگی. این روند رو به تکامل حاکی از توجه روزافزون به اهمیت فزاینده تنوع فرهنگی در حقوق بین‌الملل کنونی و درنتیجه ارتقای حقوق فرهنگی بشر است.

An Analysis to the Conceptual Development of Culture in International Human Rights Law and Its Impact on the Promotion of Cultural Rights

The present article, in a descriptiveanalytic method and on a librarybased approach, aims to investigate the conceptual development of culture in International Human Rights Law and its relationship with the promotion of cultural human rights. Culture, as the essence of being human, is central to man and without which no rights are possible. In International Law arena, culture is mostly presented in cultural rights discourse, and various expressions of the concept could be found in different international instrument. This study demonstrates that, from the establishment of UN up to now, the concept of culture has experienced three evolutional interpretations: culture as culture of elites or high culture, culture as popular culture and culture as a way of life. This evolutional process shows the increasing significance of cultural diversity in the contemporary International Law and consequently promotion of cultural rights.
