مسئولیت مدنی پزشک و پیراپزشک ناشی از عمل دیگری در حقوق ایران و فرانسه

همه ما این قاعده را خوب می‌دانیم که در مسئولیت قهری، شخص مسئول خطای زیردستان خود باشد که در هنگام انجام کار یا به مناسبت آن موجبات ورود زیان به دیگری را فراهم ساخته است. یکی از حقوق مهم اشخاص در جامعه «حق بنیادین بر حمایت از سلامت» می‌باشد و هر تجاوز به این حق اشخاص، مسئولیت به‌بار می‌آورد. مسئولیت پزشک در این موارد و جبران خسارتی که ناشی از عمل خود پزشک باشد، مسئله تازه‌ای نیست، یکی از تحولات به‌وجود‌آمده در این مورد این است که گاهی کار طبابت و معالجه گروهی انجام می‌شود و تعیین مسئول جبران خسارت در حوادث پزشکی اهمیت ویژه‌ای پیدا می‌کند. عمده مسئله قابل‌بحث در این است که چنانچه درنتیجه عمل جراحی، اقدامات درمانی، صدمه یا آسیبی به بیمار وارد آید و حتی منجر به فوت او گردد، مسئولیت آن برعهده چه کسی خواهد بود؟ آیا پزشک جراح به‌تنهایی مسئولیت خواهد داشت یا تیمی که همراه او در جریان اقدامات درمانی فعالیت دارند نیز مسئولیتی مشابه او خواهند داشت؟

The Civil Responsibility of Physician and Paramedic due to Other’s Action in Iran and France Law

All of us know the rule that in the compulsory liability if the individual provides the ground to cause a loss to other peoples or due to her/ his action the loss is caused, he/ she is liable for the fault caused by his/ her subordinates.One of the most important rights of the individuals in the society is the constitution of health protection any deviation from this right creates liability.Liability of physician in these issues and compensation for the loss created by the physician is not a new issue one of the evolutions in these cases is that sometimes medical practice is performed in group and determination of the liable for loss compensation in the medical events has a particular importance. The major issue is that if at the result of surgery or health care practices, a loss is caused on the patient or even lead to the death, who is liable? It surgeon is solely liable or the team accompanying him/ her in the treatment procedure are similarly liable?
