تعامل تمامیت ارضی با حقوق و آزادی‌های مشروع از منظر ملّی و بین‌المللی

امروزه، حفظ استقلال و تمامیت ارضی و مرزی کشورها به‌عنوان یک اصل جهانی موردِتوجه و تاکید قرار گرفته است. سازمان ملل، حقوق بین‌الملل و قانون اساسی کشورها، مهم‌ترین منادیان چنین نگرشی هستند. استقلال ارضی و تمامیت ارضی از یک‌سو و حفظ حقوق و امنیت انسانی از محورهای بسیار مهم این پژوهش به‌شمار می‌آید. همچنین نگاه مختصر به وضعیت حفظ تمامیت ارضی در خاورمیانه نیز به ما در این پژوهش به‌عنوان یک نمونه یاری رسانده است. به استناد اصول متعدد قانون اساسی، وحدت ملی و تمامیت ارضی، شرط لازم استقلال جمهوری اسلامی ایران شمرده می‌شود. به همین دلیل، اصل نهم قانون اساسی آزادی، استقلال، وحدت و تمامیت ارضی کشور را از یکدیگر جدانشدنی و حفظ آن را وظیفه حکومت ملت پایه و آحاد ملت می‌داند. حفظ تمامیت ارضی ایران و مرزهای بین‌المللی آن، به‌شدت موردِاحترام و حمایت عامه مردم و تعدّی به آن، به‌منزله تجاوز به کشور و اقتدار عمومی است. از طرفی قبول و شناخت آزادی‌های مختلف برای اقوام و قبایل گوناگون در کشور، نباید موجب لطمه به تمامیت ارضی یا محلی برای تجزیه‌طلبی شود. فصل سوم قانون اساسی جمهوری اسلامی ایران نیز با الهام از مبانی تفکر اسلامی، انواع آزادی‌های اساسی مردم را موردِتوجه و حمایت قرار داده است. تبیین دقیق رابطه آزادی، استقلال و وحدت و تمامیت ارضی می‌تواند در جلوگیری از پیدایش استبداد و نیز وابستگی و تجزیه کشور، موثر بوده و جامعه را به سمت‌وسوی نیل به سعادت سوق دهد.
