تعهدات خاص خدمات مخابرات در سازمان جهانی تجارت

سازمان جهانی تجارت، متشکل از بخش‌های مختلف است که هر دولت برای الحاق به سازمان باید درخصوص تعهدات مندرج در این بخش‌ها تصمیماتی را اتخاذ نماید. یکی از بخش‌های مهم سازمان، بخش خدمات است که تحت عنوان موافقتنامه عمومی خدمات (گاتس) تعهداتی را در این بخش بر دولت‌ها اعمال می‌نماید. گاتس خود شامل دوازده بخش و 150 زیربخش است که یکی از بخش‌های آن درخصوص تجارت خدمات ارتباطی است. یکی از زیربخش‌های این خدمت، خدمات مخابراتی هستند که در قالب‌های مختلف عرضه می‌شوند. لذا با‌توجه‌به اهمیت این زیربخش، ضمائم و اسناد دیگری هم درباره خدمات مخابرات ایجاد شده تا دولت‌ها تعهدات و ضوابط مندرج در آن را به‌صورت اتوماتیک‌وار و یا اختیاری اعمال نمایند. بر‌همین‌اساس، این پژوهش به تعهدات خاص و اسناد مربوط به تجارت خدمات مخابراتی در سازمان جهانی تجارت می‌پردازد تا مشخص نماید که دولت‌ها درروند مذاکرات خود در بخش خدمات به‌ویژه خدمات مخابرات با چه اصول و قواعدی روبه‌رو خواهند شد.

Specific Obligations of Telecommunication Services in the World Trade Organization

World trade organization consists of different parts which a state should consider its obligations under these legal conditions. One of the important parts in the WTO is trade in services which imposes different obligations to the states by the rules of General Agreement on Trade in Services (GATS). The agreement covers trade in services in the 12 different service sectors and 150 subsectors. Communication services are one of its sectors and Telecommunication services is the sub sector in this service which has been supplied in different modes. Because of the importance of this subsector, various documents and annex have been established in this field since the states can apply their obligations and requirements automatically or imperatively. In this regard, this paper considers the specific commitments and documents related to the trade in telecommunication services in the WTO.
