تبدّل ضمان مثل به قیمت

زمانی که مالِ غیر نزد غاصب یا افرادی که در حکم غاصب هستند قرار می گیرد، در ابتدا ملزم به رد عین آن است و در صورت عدم امکان رد، مکلف به ردّ مثل یا قیمت در صورت مثلی یا قیمی بودن مال، خواهند بود. اگر مال تلف شده مثلی باشد و ادای مثل، بنا به هر دلیلی متعذّر گردد، بر اساس دیدگاه های متفاوت، از طرق مختلفی قیمت به جای مثل پرداخت خواهد شد. لیکن پس از رفع تعذّر، اگر امکان ردِ مثل میسّر گردد؛ در اینکه مثل با دادن قیمت از ذمه ساقط شده است یا اینکه تفریغ ذمّه فقط با دادن مثل و ردّ قیمت به غاصب محقق می شود، میان فقهاء اختلاف نظر است. به طور کلی در این رابطه دو دیدگاه میان فقهاء وجود دارد: 1ـ استرداد قیمت و رد مثل، 2ـبرائت ذمّه نسبت به مثل با ادای قیمت. در مقاله ی حاضر سه دیدگاه درباره ی جایگزینی قیمت به جای مثل متعذّر و دو دیدگاه راجع به تفریغ ذمّه یا عدم آن با پیدا شدن مثل مورد بررسی قرار گرفته است. حاصل این پژوهش با تاکید بر مبانی متفاوت فقهاء، این است که؛ پرداخت قیمت با تراضی باعث عدم عودت مجدد مثل بر ذمهّ ی مدیون می گردد، که نظر غالب فقهاء است.
