دستیار وکیل در نظام حقوقی آمریکا و ایران

دستیاری وکیل یکی از مشاغل رسمی در نظام‏ حقوقی آمریکاست. منظور از دستیار وکیل افرادی هستند که در ارائۀ خدمات حقوقی به وکلا مساعدت می ‏کنند. در نظام حقوقی ایران علی‌رغم حضور غیررسمی برخی افراد به‌عنوان دستیار در دفاتر وکلا، این حرفه به‌طور رسمی در قوانین پیش ‏بینی نشده است. در این پژوهش توجه به این حرفه به‌عنوان راهکاری جهت حل بخشی از مشکلات بیکاری فارغ ‏التحصیلان حقوقی و بهره ‏مندی از مزایایی همچون تسهیل کار وکلا و افزایش کیفیت خدمات آن‏ها و ارتقای دسترسی به عدالت مورد توجه قرار گرفته است. با توجه به اینکه قانونمند نبودن این حرفه در عمل موانعی برای وکلا به وجود آورده و وکلای ایرانی را از بهره ‏مندی کامل از مزایای این حرفه محروم کرده است، در این پژوهش با توجه به تجربۀ مثبت آمریکا در استفاده از دستیاران، ‏ضمن معرفی دستیار وکیل در این نظام حقوقی، با بررسی مزایا و موانع این حرفه در نظام حقوقی ایران، امکان ‏سنجی پذیرش آن مورد مطالعه قرار گرفته است. قانونمند کردن این حرفه و تعیین شرایط دقیق آن در قوانین و رفع موانع موجود، پیشنهاد نگارنده در جهت بهره ‏مندی از آثار مفید این حرفه است. این پژوهش با رویکردی تطبیقی و به روش توصیفی تحلیلی نگارش یافته است. روش جمع‌آوری اطلاعات به‌صورت کتابخانه ‏ای و میدانی است. جهت بررسی موانع این حرفه در عمل در حقوق ایران، پرسش‌نامه و مصاحبه با تعدادی از وکلای دادگستری‌ای که در عمل از دستیاران استفاده کرده‌اند‏، تدوین شده و با ارزیابی و تحلیل اطلاعات حاصل‌شده، مزایا و موانع این حرفه در عمل تبیین شده است.

paralegal in the america and iran legal system

paralegal is one of the official jobs in the american legal system. paralegal refers to people who assist lawyers in providing legal services. in iran’s legal system, despite the informal presence of some people as paralegal in lawyers’ offices, this profession is not officially provided in the statute. in this research, paying attention to this profession as a way to solve part of the unemployment problems of legal graduates and to benefit from advantages such as facilitating the work of lawyers and increasing the quality of their services and improving access to justice has been considered. considering that the lack of legalization of this profession in practice has created obstacles for lawyers and deprived iranian lawyers of fully benefiting from the advantages of this profession, in this research, considering the positive experience of america in using paralegals, while introducing the paralegal in this legal system, by examining the advantages and obstacles of this profession in iran’s legal system, the feasibility of its acceptance has been studied. legalizing this profession and determining its precise conditions in the laws and removing the existing obstacles is the author’s suggestion to benefit from the positive effects of this profession and solving part of the employment problems. this research is written with a comparative approach and descriptive and analytical method. the method of collecting information is library and field working.  in order to investigate the obstacles of this profession in practice in iranian law, a questionnaire was compiled and we interviewed with a number of lawyers who used paralegals in practice, and by evaluating and analyzing the information obtained, the advantages and obstacles of this profession in practice were explained.
