تحول احراز عدالت در نظام قضائی با پردازش هوشمند داده

تحولات نوین در حوزۀ هوش ‌مصنوعی و فناوری‌ های نوظهور، مفهوم سنتی عدالت قضائی را با دگرگونی‌های اساسی روبه‌رو ساخته ‌است. ظهور پدیده‌هایی چون دادگاه‌های متاورسی، سیستم‌های قضائی خودمختار و عدالت غیرمتمرکز مبتنی بر وب 3، الگووارۀ جدیدی با عنوان «عدالت الگوریتمی» را پدید آورده‌ است. این پژوهش با رویکرد توصیفی تحلیلی ضمن مطالعۀ تطبیقیِ نظام‌های قضائی پیشتاز، به واکاوی چالش‌ها و فرصت‌های گذار از عدالت انسان‌محور به عدالت داده‌محور پرداخته‌ است. یافته‌ها نشان‌ می‌دهد علی‌رغم کارایی قابل توجه سیستم‌های هوشمندِ قضائی، مسائلی همچون وجود تبعیض الگوریتمی، چگونگی حفظ حریم خصوصی اطلاعاتی و حمایت از دادۀ شخصی همچنین مسائل مربوط به مشروعیت، مسئولیت و شفافیت در تصمیم‌گیری‌ها، مستلزم راهکارهای حقوقی   فنی نوآورانه است. در این راستا و در جهت نظام‌مندسازی جریان عدالت الگوریتمی از یک سو تدوین چارچوب‌های قانونی و از سویی دیگر بهره‌مندی از سازوکار اجرایی و نظارتی ضروری است. درنهایت این پژوهش با ارائۀ مدلی تلفیقی برای همکاری انسان و ماشین در فرایند قضائی، چارچوبی نوین برای تضمین عدالت در عصر الگوریتم‌ها را پیشنهاد می‌کند که می‌تواند در مسیر رفع و تقلیل چالش‌های موجود مورد توجه قرار گیرد.

recent advancements in artificial intelligence and emerging technologies have fundamentally transformed the traditional concept of judicial justice. the emergence of phenomena such as metaverse courts, autonomous judicial systems, and decentralized justice based on web 3 has introduced a new paradigm known as &algorithmic justice.& this study, employing a descriptive-analytical approach and a comparative analysis of leading judicial systems, explores the challenges and opportunities of transitioning from human-centric to data-driven justice. the findings indicate that, despite the significant efficiency of intelligent judicial systems, issues such as algorithmic bias, the protection of data privacy, personal data security, as well as concerns regarding legitimacy, accountability, and transparency in decision-making, necessitate innovative legal-technical solutions. to this end, the establishment of legal frameworks alongside effective implementation and oversight mechanisms is essential for systematizing the flow of algorithmic justice. ultimately, this research proposes an integrated model for human-machine collaboration in the judicial process, offering a novel framework to ensure justice in the era of algorithms, which can be utilized to address and mitigate existing challenges.
