مسئولیت آواتارها تحت فناوری متاورس

آواتارها به‌عنوان شهروندان رقومی در فناوری متاورس، که یکی از فناوری‌های نوین مبتنی بر بسترهای بلاک‌چین بوده و با بهره‌گیری از ارزهای رقومی به تازگی ظهور کرده است، دارای هویت رقومی مستقل هستند. ازجمله مهم‌ترین چالش‌های حقوقی این موضوع شناسایی مسئولیت حقوقی آواتارها با توجه به فعالیت بدون وقفه و همراه با به‌کارگیری ارزهای رمزنگاری‌شده در شبکۀ رقومی متاورس است که خود دارای ساختار اقتصادی مستقل و پویا براساس اعمال حقوقی آواتارهاست. این مطالعه در صدد است با روشی توصیفی تحلیلی به این پرسش پاسخ دهد که شناسایی مسئولیت (اعم از مسئولیت مدنی و مسئولیت قراردادی) برای آواتارها در فناوری متاورس در نظام حقوقی ایران امکان‌پذیر است؟ آواتارها می‌توانند تحت بسترهای فناوری متاورس از مزیت داشتن کیف پول‌های رمز ارزی ازقبیل تراست والت و متامسک به‌عنوان دارایی رقومی بهره‌مند شوند و به انعقاد قرارداد مبادرت ورزند. نتایج مطالعۀ حاضر مبین آن است که تا زمان مقررات‌گذاری تخصصی در این حوزه می‌توان با شناسایی شخصیت حقوقی برای آواتارها مشابه شرکت‌های تجاری جهت شناسایی حقوق و تکالیف قانونی و همچنین تحمیل مسئولیت مدنی «اعم از قهری و قراردادی» به آواتارها اعمال حقوقی آن‌ها را نظام‌مند کرد.

the introduction of blockchain technology and the growth of related platforms, notably through the rise of digital currencies, have opened a new realm of transactions in the digital space. among the leading innovations in this field is metaverse technology—a term combining “meta” (beyond) and “universe” (world)—which has given the concept of the “digital citizen” greater significance. key features of the metaverse include continuous operation, an independent and dynamic economic structure, cross-platform expansion, and the ability to conduct transactions using digital currencies. individuals, whether natural or legal persons, can engage in legal actions within the metaverse and its platforms by registering and obtaining an avatar. currently, non-fungible tokens (nfts) as digital assets have expanded the scope of avatar-driven legal actions in this environment. while digital currencies are not mandatory in the metaverse, they significantly enhance its potential, fostering a digital economy built on utility tokens and unique nft collections. additionally, the metaverse leverages cryptocurrency wallets like trust wallet and metamask to facilitate these activities.this article explores the concept of metaverse technology and its characteristics, employing a descriptive-analytical method to examine the multifaceted legal actions performed by avatars. it concludes by proposing a legal framework that assigns legal personality to avatars, enabling the recognition of their rights and obligations and the imposition of civil liability—both contractual and tort-based—in this digital domain.
