روش های مسالمت آمیز حل وفصل اختلافات بین المللی و تاثیر آن بر توسعه تجارت بین الملل؛ با تاکید بر اختلافات صنعت انرژی

دعاوی حقوقی درخصوص تجارت بین الملل از یک جهت نشانگر میزان مشارکت کشورها در تجارت بین الملل و همچنین فعالیت‌های تجاری آن در مسائل مختلف اقتصادی است. از آن جهت که انرژی در دوران کنونی یکی از پایه های اصلی تجارت بین الملل محسوب می شود و حل‌وفصل دعاوی و اختلافات بین المللی یا شکست در این زمینه می تواند نقش مهمی در تجارت بین الملل داشته باشد. این موضوع به‌خصوص در بخش انرژی که جایگاه مهمی در تجارت بین‌الملل ایفا می کند، مشهود است. در همین زمینه، نوشتار حاضر این پرسش را پیش می کشد که به‌کارگیری روش های مسالمت آمیز حل‌وفصل اختلافات بین المللی در بخش انرژی چگونه می تواند بر توسعه تجارت بین الملل اثرگذار باشد؟ فرضیه این است که بهره گیری از رویکردهای دیپلماتیک مخصوصاً توجه به پیمان منشور انرژی توسط کشورهای مختلف به‌شکل قابل‌توجهی می تواند میزان مراجعه به دیوان داوری بین المللی را کاهش دهد. در این زمینه بهره گیری از روش های دولت سرمایه گذار، روش های دیپلماتیک، ایجاد مراکز حل اختلاف میان دوطرف می توانند به‌عنوان رویکردهای جایگزین مراجعه به دیوان داوری بین‌المللی محسوب شوند و کشورها پیش از مراجعه به آن، دعاوی خود را حل کنند و موجب توسعه تجارت در عرصه بین المللی شوند. نوشتار حاضر به‌دلیل توجه به نقش روش های مسالمت‌آمیز در حل‌وفصل اختلافات بین المللی در بخش انرژی از روش توصیفی- تحلیلی بهره می برد که با استفاده از منابع کتابخانه ای و اسنادی نسبت به جمع آوری داده ها اقدام کرده است.

peaceful methods of the international disputes settlement and their impact on the development of international trade; with emphasizing on the scope of the energy industry

international trade litigation represents, the extent to which countries participate in international trade, as well as its business activities on various economic issues. since energy is one of main pillars of international trade, settlement international disputes can play an important role in international trade.this is especially evident in the energy sector, which plays an important role in international trade. in this regard, the present paper raises the question how can the use of peaceful methods of resolving international disputes in the energy sector have an impact on the development of international trade? it is hypothesized that the use of diplomatic approaches, in particular the consideration of the energy charter treaty by different countries, could significantly reduce the rate of referral to the international court of arbitration. in this regard, the use of investor government methods, diplomatic methods, the establishment of dispute settlement centers can be regarded as alternative approaches to the international court of justice, and countries may seek litigation before it.resolve themselves and promote the development of commerce internationally. the present paper uses a descriptive-analytical method to collect data due to the role of peaceful methods in resolving international disputes in the energy sector using library and documentary sources
