ضمانت اجراهای نقض مقررات ماهوی قانون پیش فروش ساختمان

قانون پیش فروش ساختمان، قانونی است خاص، جهت سر و سامان دادن به قراردادهای پیش فروش ساختمان و تنظیم روابط طرفین این قرارداد. وضع این قانون این اثر مهم را به دنبال داشته که قرارداد پیش فروش ساختمان را که قبل از تصویب این قانون، قرارداد غیر معین بوده، به قرارداد معین و بانام تبدیل کرده است. این قانون همچنین متضمن مواد و احکامی است که بررسی ضمانت اجرای آنها از اهمیت بسزایی برخوردار است؛ از جمله می توان به مواد 1 و 2 قانون مزبور اشاره کرد. تبعیت هر قرارداد پیش فروش، در هر قالب و عنوانی که منعقد شود از این قانون؛ تعیین و احصاء اشخاصی که می توانند اقدام به پیش فروش ساختمان نمایند و نیز پیش بینی داوری اجباری از جمله احکام اصلی قانون نامبرده می باشد. این مقاله با بررسی ضمانت اجراهای نقض مقررات ماهوی قانون پیش فروش ساختمان در صدد ارائه راه حل ها و ضمانت اجراهای نقض این قانون است.کلمات کلیدی: قانون پیش فروش ساختمان عقد معین قرارداد پیش فروش ساختمان ضمانت اجرا

Being protected by sanction of violation of law of looking in to preselling law of building

AbstractPreselling law of building is a specific law that is used for organizing preselling agreement of building and setting the relationship between th parties of this agreement. Legislation of this law has changer the preselling agreement of building into specified agreement which was a nonspecified agreement before approval of this rule. This law includes the articles and orders which study sanction of them are important. We can mention the articles 1 and 2 of mentioned rule. Topic, determination of the people who can make a preselling agreement and also anticipation of compulsive judgment are of main orders of mentioned articles. The aim of this paper is stadysanction breaching provisions of preselling law of building in order to present the solutions and sanctions breaching of this code.Key words: preselling law of house ndash; specified agreement preselling agreement of house sanction
