تحلیل مبانی فلسفی حقوق بنیادین ملت از منظر علامه مصباح یزدی

مردم در جامعۀ سیاسی دارای حقوق و آزادی‌های عمومی‌اند که به بخشی از آنها با عنوان حقوق بنیادین ملت، در قانون اساسی تصریح شده است. همۀ نظامهای سیاس از مبانی اندیشه‌ای و فلسفی برگرفته از حاکمیت اندیشه‌ها و ایدئولوژی شکل گرفته‌اند. از این رو، بر اساس نوع نگرش فلسفی حاکم بر نظام سیاسی، قانون اساسی را تدوین و تصویب کرده و در نهایت، مبانی فلسفی خود را در ارکان و ساختار حکومتها و نیز در نوع نگرش به حقوق بنیادین ملت متبلور می‌سازند. هدف: هدف این پژوهش، تبیین نگرش فلسفی و حقوقی علامه مصباح یزدی و نیز تاثیر این رویکرد در تعیین مبنا و منشا حقوق بنیادین برای ملت در حکومت اسلامی بود. روش: مقالۀ حاضر با روش تحلیلی‌– توصیفی، مبانی فلسفی حقوق بنیادین ملت را از منظر علامه مصباح یزدی بررسی کرده است. یافته: علامه مصباح یزدی به عنوان یکی از بزرگ‌ترین فیلسوفان و نظریه‌پردازان معاصر، مبانی فلسفی حقوق بنیادین ملت را در همگرایی حقوق ملت با شریعت، کمال‌باوری، کرامت انسانی و فرجام‌باوری خلاصه کرده است. نتیجه‌گیری: از منظر علامه مصباح یزدی، مشروعیت حقوق و آزادی‌های بنیادین برای افراد بشر در نظام اسلامی، در چارچوب تعیین‌شده توسط شارع مقدس و در گرو انطباق با مبانی دینی است؛ به نحوی که محدودۀ اعمال حقوق بنیادین توسط ملت با اندیشۀ خدامحوری و وابستگی وجودی انسان با خداوند و همچنین رعایت اصول کمال‌محوری، فرجام‌باوری و کرامت انسانی تعیین شده است.

.analyzing the philosophical foundations of the nation’s fundamental rights from the perspective of allameh misbah yazdi

.the nation in the political society has public rights and freedoms, some of these rights and freedoms are specified in the constitution, which is interpreted as the fundamental rights of the nation. all political systems consist of ideological and philosophical foundations that are derived from the sovereignty of ideas and ideology. therefore, based on the type of philosophical attitude that governs the political system, they formulate and approve the constitution and finally crystallize their philosophical foundations in the pillars and structure of governments and also in the type of attitude towards the fundamental rights of the nation. aim: the purpose of this research is to explain the philosophical and legal attitude of allameh misbah yazdi and also the effect of this approach in determining the basis and origin of fundamental rights for the nation in islamic government. method: the present article has been analyzed with the analytical-descriptive method of the philosophical foundations of nation’s fundamental rights from the perspective of allameh misbah yazdi. results: allameh misbah yazdi, as one of the greatest philosophers and theoreticians of the present age, has summarized the philosophical foundations of the nation’s fundamental rights in the convergence of the nation’s rights with the sharia, the perfection of belief, human dignity and the ultimate goal. conclusion: from the point of view of allameh misbah yazdi, the legitimacy of fundamental rights and freedoms for human beings in the islamic system is within the framework determined by the holy law and is subject to compliance with religious principles. it has been in such a way that the scope of the application of fundamental rights has been determined by the nation with god-centered thinking and the existential dependence of man on god, as well as the observance of the principles of perfection-centeredness, the end of faith and human dignity.
