معیارهای بینشی حل دو راهه اخلاقی استقلال و استبداد رای در داوری بر اساس منابع دینی

هدف: داوران در زمان تصمیم برای صدور حکم، گاهی دچار تحیّر میان استقلال و استبداد می‌شوند که تنها با شناخت ماهیت و معیارهای آن قابل تمایز است. آثار مکتوب موجود در این زمینه به استقلال قاضی، از زوایای حقوقی، فقهی و سیاسی پرداخته و فاقد بررسی برای شناخت آن دو از حیث بینشی‌اند. حل چنین مسئله‌ای در شبکه‌ای از حوزه‌های مختلف امکان‌پذیر بود که هدف این پژوهش حل این دو راهه اخلاقی، از طریق حوزه بینشی و بر اساس منابع دینی بود. روش: روش تحقیق در این پژوهش، تحلیلی و کاربردی بر اساس منابع معتبر کتابخانه‌ای بود. یافته‌ها: استخراج چهار معیار صحّت نگرش به مبادی وجود، شناخت ظرفیتهای تحلیلی و محدودیتهای هیجانی، شناخت حقیقی مبادی معرفت معنوی و التزام به آن، توجه به فرجام تکلیفی و تدوینی و تکوینی داوری که علاوه بر دستگاه قضایی، در تصمیم‌گیری‌های فردی و سازمانی نیز ضروری بود. نتیجه‌گیری: این پژوهش، معیارها، نشانگرها و مصادیق استقلال و استبداد را با توجه به حوزه بینشی بیان کرده است تا داوران در موقعیت های مواجه شده، توانایی خروج از این دو راهه اخلاقی را داشته باشد.

judgment insight criteria to solve two ethical paths of independence and despotism in based on religious sources

objectives: judges sometimes make the distinction between independence and despotism when deciding on a sentence that can only be distinguished by understanding its nature and criteria. all the written works in this field dealt with the judge’s independence from legal, jurisprudential and political perspectives and lacked any insight into their understanding. it was possible to solve such a problem in a network of different domains. the purpose of this study is to solve these two ethical paths through a religious domain based on insight.method: the research method in this study is analytical and applied based on valid library resources.results: extraction of four criteria: correctness of attitude towards the origin of existence, recognition of analytical capacities and emotional limitations, real recognition of the origins of spiritual knowledge and its attachment, consideration of assignment, formulation and developmental judgment in addition to the judiciary, it was also essential for individual and organizational decisionmaking.conclusion: this study stated the criteria, indicators and instances of independence and despotism with regard to the field of vision, so that the referees in the situations faced can be able to depart from these two ethical paths.
