چکیده
|
سابقه و هدف: دوپینگ در ورزش بهعنوان استفاده غیرمجاز از داروهای نیروزا یکی از معضلات اساسی رقابتهای ورزشی به شمار میرود که پیامدهای جسمانی، اخلاقی و حقوقی فراوانی برای ورزشکاران و نهادهای ورزشی به همراه دارد. هدف از این مقاله، بررسی انواع داروهای دوپینگ، روشهای آنالیز آنها و چالشهای حقوقی مرتبط با این حوزه است.این یک مطالعه مروری است که با استفاده از منابع معتبر علمی و حقوقی انجام شده است. ابتدا انواع داروهای نیروزا و تاثیرات آنها بر عملکرد ورزشکاران معرفی شد. سپس روشهای آنالیز داروها شامل کروماتوگرافی گازی-طیفسنجی جرمی (gc-ms)، کروماتوگرافی مایع- طیفسنجی جرمی (lc-ms/ms) و روشهای ایمونواسی مورد بررسی قرار گرفت. همچنین، با مطالعه تطبیقی، چالشهای حقوقی قوانین ایران در مقابله با دوپینگ با قوانین ایالات متحده و استانداردهای بینالمللی مقایسه شد.نتایج نشان داد که روشهای تحلیلی پیشرفتهای مانند gc-ms و lc-ms/ms با وجود دقت بالا، به تجهیزات گران قیمت و زمان آمادهسازی طولانی نیاز دارند. در عین حال، روشهای ایمونواسی به دلیل سهولت و هزینه کمتر، در غربالگری اولیه موثرند، اما با محدودیتهایی مانند نتایج مثبت و منفی کاذب مواجه هستند. از نظر حقوقی، تفاوت در قوانین ملی کشورها و نبود هماهنگی کامل با مقررات جهانی، از جمله چالشهای اساسی در اجرای موثر قوانین ضد دوپینگ محسوب میشود. در ایران، استفاده از مواد نیروزا عمدتاً تخلف انضباطی تلقی شده و تنها در شرایط خاص جرمانگاری میشود.بهمنظور کاهش تقلبهای ورزشی و ارتقای سلامت ورزشکاران، توسعه روشهای دقیقتر تشخیص دوپینگ و هماهنگی بینالمللی در تدوین قوانین ضروری به نظر میرسد. همچنین ایجاد بسترهای قانونی مناسب در ایران میتواند به بهبود روند مقابله با دوپینگ و افزایش شفافیت در عرصه رقابتهای ورزشی کمک کند

Abstract
|
doping in sports, defined as the unauthorized use of performance-enhancing drugs, is a critical issue in athletic competitions, with significant physical, ethical, and legal implications for athletes and sports organizations. this article aims to explore the types of doping substances, their analytical detection methods, and the associated legal challenges. this is a review study based on reliable scientific and legal literature. it first introduces various performance-enhancing drugs and their effects on athletes’ performance. subsequently, the analytical methods, including gas chromatography-mass spectrometry (gc-ms), liquid chromatography-tandem mass spectrometry (lc-ms/ms), and immunoassay techniques, are examined. furthermore, a comparative analysis is conducted on the legal challenges in iran’s anti-doping regulations in comparison with those of the united states and international standards. the findings reveal that while analytical techniques such as gc-ms and lc-ms/ms are highly accurate and advanced, they require costly equipment and involve lengthy sample preparation. meanwhile, immunoassay methods, due to their simplicity and lower cost, are effective for initial screening but are limited by the potential for false-positive and false-negative results. legally, differences in national regulations and a lack of full alignment with international standards pose significant challenges to the effective enforcement of anti-doping laws. in iran, the use of performance-enhancing substances is primarily regarded as a disciplinary violation and is only subject to criminal prosecution under specific conditions. overall, to reduce sports fraud and enhance athletes’ health, the development of more accurate doping detection methods and the international harmonization of anti-doping legislation are essential. additionally, establishing appropriate legal frameworks in iran can strengthen the fight against doping and increase transparency in sports competitions.
