همکاری ایران با کنوانسیون حفاظت از گونه‌های مهاجر حیوانات وحشی cms در قالب تفاهم‌نامه‌ها

کنوانسیون حفاظت از گونه‌های مهاجر حیوانات وحشی که بانام cms و کنوانسیون بن نیز شناخته می‌شود یکی از مهم‌ترین اسناد حقوقی الزام‌آور بین‌المللی درباره‌ی حفاظت و مدیریت گونه‌های مهاجر به شمار می‌آید. این کنوانسیون، معاهده‌ای است که بر پایه آن‌ تمام گونه‌های مهاجر در خشکی، آب ‌و هوا در گستره زندگیشان تحت محافظت قرار می‌گیرند. کنوانسیون cms همه دولت‌های عضو ازجمله ایران را متعهد به ایجاد تدابیر حفاظتی هماهنگ برای حیوانات مهاجر می‌نماید و با بسترسازی لازم، با تاکید بر اصول پایه‌ای همکاری و پیشگیری به امر حفاظت از گونه‌های مهاجر در تمام‌مسیر مهاجرتشان و زیستگاه آن‌ها می‌پردازد. در این راستا تاکنون هفت توافق‌نامه الزام‌آور و نوزده تفاهم‌نامه اجرایی به‌منظور حفاظت از گونه‌های مهاجر مختلف، تحت حمایت کنوانسیون cms منعقدشده است که از این میان ایران تاکنون با چهار تفاهم‌نامه قرارداد همکاری امضا کرده است. در این مقاله، این چهار تفاهم نامه مورد مطالعه و بررسی قرار گرفته است. تحقیق حاضر با استفاده از روش توصیفی – تحلیلی قصد دارد به بررسی چگونگی عمل به مفاد کنوانسیون cms، خلاء های قانونی و اجرایی و چالش‌های پیش روی آن با تاکید بر وضعیت ایران، بپردازد. یافته‌های این پژوهش نشان می‌دهد که علیرغم  فعالیت‌ها و اقدامات مفید گسترده‌ در ارتباط با گونه‌های مهاجر ایران در چارچوب این چهار تفاهم‌نامه و در پرتو همکاری با کنوانسیون cms باگذشت چهار دهه از تشکیل این کنوانسیون و بیش از دو دهه همکاری ایران با آن، هنوز نتایج رضایت‌بخش در وضعیت حفاظتی بسیاری از گونه‌ها به‌طور کامل محقق نشده است. شایسته است با رفع ضعف‌های حقوقی و اجرایی و به‌کارگیری مدیریت کارآمد، عاقلانه و متمرکز و همچنین همکاری تمام ارگان‌ها و آحاد مردم، این بخش از تنوع زیستی در ایران موردحفاظت و حمایت مطلوب قرار گیرد.

cooperation of iran with the convention on the conservation of migratory species of wild animals cms in the form of memorandums

the convention on the conservation of migratory species of wild animals, also known as cms or the bonn convention, is one of the most important international legally binding agreements on the conservation and management of migratory species. it is a treaty under which all terrestrial, aquatic and avian migratory species are conserved. the cms commits all states parties, including iran, to establish concerted action for migratory animals, and with the necessary infrastructure, emphasizes the basic principles of cooperation and prevention to protect migratory species throughout their migration and habitat. so far, seven legally binding agreements and nineteen executive memorandums of understanding have been concluded under the auspices of the cms. in this article, these four memoranda of understanding have been studied. the present study, using a descriptive-analytical method, intends to examine how to implement the provisions of the cms convention, its legal and executive gaps and the challenges faced by emphasizing the situation of iran. the findings of this study show that despite extensive activities and useful measures related to iranian migratory species within the framework of these four agreements and in the light of cooperation with the cms convention, four decades after its establishment and more than two decades of cooperation with iran, still the satisfactory results in the conservation status of many species is not fully performed. it is deserved that this part of the biodiversity of iran should be protected and supported favorably by eliminating legal and executive weaknesses and employing efficient, wise and centralized management as well as the cooperation of all organs and the people.
