پیشگیریِ غیر کیفری از بهره‌برداریِ غیرقانونی از معادن و متولیانِ آن در ایران

معدن محلی است که در آن انواع فلزات و سنگ‌ها که دارای ارزش اقتصادی هستند انباشته‌شده‌اند. هرگونه برداشت از آن مستلزم اخذ پروانه بهره‌برداری از سازمان صنعت، معدن و تجارت است. در غیر این صورت بهره‌برداری غیرقانونی تلقی می‌شود و واکنش های کیفری در این زمینه ناکافی به نظر می رسد. بر این اساس هدف پژوهش حاضر بررسی سازوکارهای پیشگیری غیر کیفری در قبال بهره‌برداری غیرقانونی از معادن در ایران هست.روش تحقیق گردآوری داده‌ها به‌صورت اسنادی است و روش تجزیه‌وتحلیل داده‌ها، به‌صورت تحلیلی - توصیفی می‌باشد.به لحاظ اهمیت معادن مقنن باید درصدد باشد که با تدوین قوانین پیشگیرانه نسبت به پیشگیری از بهره‌برداری غیرقانونی از معادن بپردازد، متاسفانه این اقدامات به‌صورت منسجم نمی‌باشد و این امر نشان می‌دهد ‌که بهره‌برداری غیرقانونی از معادن همواره یک چالش اساسی برای کشور بوده است، لذا توسل به طرق پیشگیری غیر کیفری دارای اهمیت است.نتایج تحقیق موید آن است که سیاست جنایی ایران در قبال بهره‌برداری‌های غیرقانونی از معادن بیشتر جنبه سرکوبگرانه دارد تا پیشگیرانه. اعمال شیوه‌های گوناگون پیش‌گیری اجتماعی و وضعی با توجه به آموزه‌های جرم شناختی، به‌طور هم‌زمان نقش موثری در کنترل بهره‌برداری غیرقانونی از معادن دارد. آموزش و آگاهی، ارتقای فرهنگ عمومی وغیره ازجمله اقدامات پیش ‌گیری اجتماعی و اعمال تدابیر نظارتی در ابعاد گوناگون آن در زمره راهکارهای پیش ‌گیری وضعی هستند که می‌توانند برای کاهش موارد وقوع بهره‌برداری غیرقانونی از معادن به اجرا گذاشته شوند.

The Non-criminal prevention the illegal exploitation of mines and its agents in Iran

Mining is the place where has been accumulated metals and stones with economic values. Any harvesting operation requires a license from the industry, mine and trade Organization And criminal reactions in the field seems to be inadequate. The aim of this study preventive mechanism against illegal exploitation of mines in Iran.Data collecting method is documentary and data analysis method is analyticaldescriptive.Due to the importance of mines the legislator by the deterrent legislation should be sought to prevent the illegal exploitation of mines, unfortunately, this procedure is not coherent and it shows in exchange of illegal exploitation of mines the criminal policy of Iran, More repressive to preventive aspects. Pointed out that the illegal exploitation of mines has always been a major challenge for the country, therefore, it is important to resort to preemptive ways.According to the teachings of criminology, applying various forms of social and situational prevention can also play an important role in controlling the illegal exploitation of the mines. Education and awareness, promotion of popular and situation culture, including measures of social prevention and control measures applying in its aspects, are among the situational prevention strategies that can be used to reduce the incidence of illegal exploitation of mines.
