ادله فقهی حرمت ساخت و به‌کارگیری تسلیحات هسته‌ای در راهبرد بازدارندگی اسلام

شناخت نادرست از مبانی اعتقادی رفتار دولت اسلامی در حوزه‌های راهبردی از جمله روش‌های بازدارندگی عاملی موثر در بدفهمی بازیگران نظام بین‌الملل از رویکردهای راهبردی واقعیِ آن دولت است. بر این اساس، بدفهمی نسبت به نیات هسته‌ای جمهوری اسلامی ایران، یکی از مشکلات قدرت‌ها طی دو دهه گذشته بوده است. به نظر می‌رسد هنوز تحقیق مجزایی که بتواند ارتباط وثیق مبانی اعتقادی اسلام با راهبرد هسته‌ای دولت اسلامی نشان دهد انجام نشده است. لذا، پرسش اصلی این مقاله این است که وضعیت جواز/عدم‌جواز(حرمت) ساخت و به‌کارگیری تسلیحات بازدارنده هسته‌ای در تقابل با دشمنان مجهز به چنین تسلیحاتی چگونه است؟ آموزه‏های حاصل از تفسیر متن قرآن حاکی از حرمت قطعیِ فقهی این موضوع در چارچوب راهبرد بازدارندگیِ دولت اسلامی است. هدف مقاله آن است که نشان دهد الزام به عدم تولید و به‌کارگیری سلاح هسته‌ای نه به دلیل محدودیت‌های حقوق بین‌الملل و مخالفت قدرت‌ها، بلکه برخاسته از مبانی اعتقادی ناشی از الزامات قرآنیفقهی است.این نوشتار در چارچوب روش تفسیر اجتهادی  می‌کوشد به نظر شارع مقدس درباره تولید و استفاده از سلاح‌های کشتار جمعی در راهبرد بازدارندگی نزدیک شود. برجسته‌سازی مبانی قرآنیفقهی دالّ بر حرمت ساخت و به‌کارگیری تسلیحات اتمی (به عنوان نظر غالب)،در مقابل نظر ضعیف دالّ بر ساخت آنها، مهم‌ترین نوآوری و نتیجه مقاله پیش‌رو خواهد بود.

Jurisprudence reasons for sanctity of construction and use of nuclear weapons in the deterrence strategy of Islam

Misunderstanding of theological basis for behavior of an Islamic State in strategic spheres, such as deterrence methods, is an effective factor on misconception of international actors to real strategic approach of that state. Therefore, misconception of I.R.I real intention of nuclear activities, have been a continuous concern for some nuclear powers during the two recent decades. It seems it have not yet done a separate research to indicate the firm linkage between theological basis of Islam and atomic power role in its deterrence. Hence, the important question is that whether construction and use of nuclear weapons in Islam would be permitted or not? Prevalent interpretation of Quran signifies to a certain Jurisprudence Sanctity of this issue in the framework of deterrence strategy utilized by an Islamic state such as I.R.I. This article emphasizes that the commitment to nonproduction, accumulation and use of nuclear weapons, is rooted in Islamic beliefs and Quran teachings rather than opposition of powers and so is not a tactical action. In the framework of ijtihad rational interpretation, this article tries to look for real will of holy legislator about construction and use of these weapons against Koffar. Signalizing teachings of Quran and Jurisprudence to Sanctity of construction and use of nuclear weapons (as the dominant idea), versus the weak idea permitting construction of them would be considered main achievement and conclusion of this writing.
