امتناع حکمرانی حزبی؛ آسیب‌شناسی رابطه نظام حزبی و نظام انتخاباتی در جمهوری اسلامی ایران

اگر کارویژه اصلی احزاب را دست یابی به قدرت و کسب کرسی‌های نمایندگی بدانیم، مهم ترین مسئله‌ای که پیش روی کنشگران سیاسی قرار می‌گیرد، فراهم کردن بسترهای نهادینه و قانون مند جهت مشارکت سیاسی افراد و گروه‌های مختلف اجتماعی است و در همین زمینه نظام انتخاباتی و رابطه ی آن با نظام حزبی اهمیت پیدا می‌کند. در ایران به دلیل کاستی‌های نظام انتخاباتی، نظام حزبی با بحران عدم نهادینگی و بی ثباتی مواجه است. از این رو، پرسش اصلی این مقاله این است که چرا علی‌رغم وجود آزادی تشکیل احزاب سیاسی در قوانین ایران، حکمرانی حزبی شکل نگرفته است؟ این مقاله با روشی توصیفی تحلیلی و با استفاده ‌از چشم انداز نهادگرایانه، به دنبال بررسی نقش نظام حقوقی و به تبع آن قوانین و مقررات حاکم بر احزاب و انتخابات در شکل‌گیری و تثبیت نظام حزبی در ایران است. بررسی قوانین حاکم بر احزاب از بدو شکل‌گیری نظام جمهوری اسلامی نشان می‌دهد که ایجاد موانع گوناگون و عدم توازن میان حقوق و تکالیف احزاب در این قوانین، از عوامل اصلی و بی واسطه ی عدم نهادینگی احزاب و حکمرانی حزبی است. در واقع، قواعد نهادی (قانون انتخابات و احزاب) در جمهوری اسلامی، به‌جای آن‌که مشوق شکل‌گیری و تثبیت سازوکارهای حزبی باشند، آنها را تخریب و تضعیف کرده‌اند.

Refusal‌ of‌ Party‌ Governance;‌ An‌ Analytical‌ Introduction‌ to‌ the‌ Relationship ‌between‌ the‌ Party‌ System‌ &‌ the‌ Electoral‌ System‌ in‌ Iran

If we consider the main task of the parties to achieve power and obtain the seats of the representatives, the most important issue facing political actors is to provide institutional and legal framework for the political participation of individuals and groups of society, and in this regard, the electoral system and its relationship with the party system matters. In Iran, due to weakness of the electoral system, the party system faces a crisis of lack of institutionalization and instability. Therefore, the main question of this article is why, despite the freedom to form political parties in Iranian law, party governance have not been formed? This article, using a descriptiveanalytical method and using an institutionalist perspective, seeks to examine the role of the legal system and, consequently, the laws and regulations governing parties and elections in shaping and consolidating the party system in Iran. The study of the laws governing the parties since the formation of the Islamic Republic of Iran shows that the creation of various barriers and the imbalance between the rights and duties of parties in these laws are the main and direct factors of the lack of institutionalization of parties and party governance. In fact, the institutional rules)electoral law and parties( in the Islamic Republic have destroyed and weakened them instead of encouraging the formation and consolidation of party mechanisms.
