تحلیل نسبت تحریم‌های اقتصادی یک جانبه با حقوق بین‌الملل معاصر

این مقاله به تحلیل نحوه تعامل دو متغیر حقوق بین‌الملل و تحریم‌های اقتصادی یک‏جانبه با یکدیگر می‌پردازد. سوال این است که چرا با وجود گسترش حقوق بین‌الملل طی سده اخیر، گرایش دولت‌ها به استفاده یک‏جانبه از تحریم‌های اقتصادی افزایش یافته است. مقاله حاضر این پاسخ را مطرح می ‏کند که حقوق بین‌الملل بر منع جنگ تمرکز کرده و در برابر استفاده یک‏جانبه دولت‌ها از تحریم‌های اقتصادی موانع محکمی ایجاد نکرده است. برای دفاع از ادعای مذکور از تحلیل نظری - حقوقی استفاده خواهد شد. مقاله به لحاظ نظری از دو تئوری لیبرالیسم و رئالیسم بهره می‌گیرد.

analyzing the relation of unilateral economic sanctions with contemporary international law

this article analyzes how the two variables of international law and unilateral economic sanctions interact with each other. the question is why despite the expansion of international law during the last century, the tendency of governments to unilaterally use of economic sanctions has increased. the current article proposes the answer that international law focuses on the prohibition of war and has not created strong barriers against the unilateral use of economic sanctions by governments. theoreticallegal analysis will be used to defend the said claim. theoretically, the article uses the two theories of liberalism and realism.
