نظام حقوقی و حقوق بشر در عربستان

نظام سیاسی و حقوقی عربستان بر پایه سازگاری با شریعت و سنت، حقوق بشر در معنای فردمحور را طرد می‏‏کند. در این کشور، فرد در درون جمع و همنوا با گزاره‏‏های بنیادین و فراگیر پرداخته شده در بستر سنت و فرهنگ جامعه جای داشته و از این رو، تهدید حقوق بشر برای آینده آن چندان نمود ندارد. همین نگاه برای نظام حقوقی عرفی و شریعت‏‏محور عربستان نیز صادق است؛ چون به اندازه کافی با سپهر فرهنگی و اجتماعی شبه‏‏جزیره سازگاری دارد و نیازی به قانون‏گذار و قانون ندارد. با این حال، دگرگونی‏‏های سیاسی و منطقه‏‏ای در سال‏‏های اخیر، حقوق بشر را به عنوان تهدیدی برای عربستان پیش می‏‏کشد؛ جایی که حقوق اقلیت شیعه و نیز حقوق زنان و کودکان و دیگران درگیر در جنگ‏‏های خاورمیانه به ویژه جنگ یمن مطرح می‏شود.

The Saudi Arabia’s Legal System and Human Rights in the Country

The Saudi Arabia political and legal system is somehow consistent with the Sharia and tradition and so there is no room for human rights. The individual in this country is within the foundational and comprehensive concepts based in tradition and so human rights cannot challenge the society in future. The same perspective is the case with regards to secular or religious legal system of the country as it is consistent enough with the social and cultural espatial of the Arab peninsula and it doesn’t need the legislation or legislator. However, the recent regional developments have emerged human rights as a threat against Saudi Arabia; a country in which the rights of its minority Shiite groups along with women’s and the children right  are being raised especially in the war in Yemen.
